OMAHA, Neb. (AP) — An Omaha man has been found not guilty of first-degree murder in a 2013 fatal shooting.

A jury in Douglas County District Court returned the verdict Friday in the trial of 24-year-old Anthony Floyd.

Floyd was accused of shooting 31-year-old Rodney Hunt in October 2013 near a motel. Hunt was shot in the head.

Floyd was also found not guilty of use of a firearm to commit a felony and possession of a firearm by a prohibited person.

In April, while awaiting trial, Floyd had his testicles partially detached during a fight with another inmate. He underwent surgery to reattach them.

OMAHA, Neb. (AP) — The Nebraska Supreme Court says a woman who had part of her lower lip bitten off by a dog she was watching has no right to seek payment of medical expenses from dog owner’s home insurance company.

Jennifer Van Kleek, of Omaha, agreed in July 2011 to care for the dog of friends without pay while they were on vacation. She filed a claim with Farmers Insurance Exchange, the friends’ homeowner’s insurance provider, after being bitten.

Farmers denied her claim, saying that because she was caring for the dog, she was legally responsible for it and therefore considered an “insured” under the homeowner’s policy. That policy excludes coverage for bodily injury to any insured.

On Friday, the state’s high court upheld a Douglas County District Court’s dismissal of her claim.

BEATRICE, Neb. (AP) — A Gage County man hoping to scare his wife by jumping in front of her moving vehicle got a scare of his own.

Gage County Sheriff’s deputies were called to Beatrice Community Hospital last Friday for a possible domestic assault. But the couple explained that the husband’s injuries occurred after he got the idea to scare his wife while he was waiting for her to pick him up from a house.

As she approached the house in her sport utility vehicle, the husband jumped from behind some trees onto the street.

The woman was unable to stop the SUV before hitting him.

The husband suffered minor injuries and was taken to the hospital by his wife for treatment.

DAKOTA CITY, Neb. (AP) — A 23-year-old Iowa man convicted of killing a northeast Nebraska woman has requested a new trial.

The attorney for Raymond Gonzales Jr. filed the motion on Wednesday. The attorney says problems with the trial include jury misconduct and a verdict not supported by sufficient evidence.

A jury on Dec. 9 found Gonzalez guilty of first-degree murder and use of a firearm to commit a felony. Authorities say he shot 28-year-old Bonnie Baker 16 times in December 2013 at a party in her South Sioux City home.

Witnesses say Gonzales became upset after people at the party teased him.

A district judge has ordered a hearing on the motion for Feb. 5, the same day Gonzales is scheduled to be sentenced.

LINCOLN, Neb. (AP) — The former owners of a southeast Nebraska gun shop are going to prison for sales and income tax evasion.

Robert Androyna and Hope Androyna were sentenced Thursday in Lancaster County District Court. Robert Androyna was given two consecutive 18- to 36-month prison terms. His ex-wife was given two one-year terms to be served at the same time.

The two pleaded no contest in October to failing to pay sales and income tax.

State officials say their gun business took in $3.78 million from 2009 through 2012, but they did not report any income or send in nearly $200,000 collected in local and state sales taxes.

Officials had said the Androynas owed more than $479,000, but agreed to pay $187,000 in restitution.

COLUMBUS, Neb. (AP) — An eastern Nebraska man has pleaded guilty to exposing himself to two 17-year-old girls at a city library.

22-year-old Mitchell Ryan admitted to two counts of public indecency on Thursday. Prosecutors dropped a charge of obstructing a police officer in the plea deal.

Police were called to the library on Oct. 27 by the high school students. The arresting officer says Ryan pulled away from him and fled on foot during the arrest. He was later found hiding in a dumpster.

Ryan faces up to a year in jail when he is sentenced in January. He was previously convicted of indecent exposure in September 2013.

GLENWOOD, Iowa (AP) — A Libertarian candidate running for the Iowa Senate seat vacated by U.S. Senator-elect Joni Ernst faces a misdemeanor sexual assault charge in eastern Nebraska.

69-year-old Donald Brantz has also been charged with assault, disturbing the peace and interfering with a public service company in Sarpy County.

Prosecutors say Brantz is accused of inappropriately touching a woman on Oct. 10 and threatening to choke her. Authorities say he hung up a phone the woman used to call 911.

Brantz has pleaded not guilty. His attorney, Chad Primmer of Council Bluffs, did not immediately return a message Friday.

Brantz is a former Mills County Board member. He faces Republican Mark Costello, of Imogene, and Democrat Steven Adams, of Red Oak, in the Dec. 30 election.

PIERCE, Neb. (AP) — A Columbus man has been sentenced to 10 to 14 years in prison for the shooting death of a Norfolk teenager in 2011.

24-year-old Daniel Hofmann was sentenced Thursday in Pierce County District Court. He had pleaded guilty to manslaughter in October, when he admitted to shooting his friend, 18-year-old Wesley Kuester, in April 2011. Three other charges were dropped as part of the deal.

Authorities say Hofmann shot Kuester with a shotgun while they were playing with guns after drinking.

Hofmann had faced up to 25 years in prison.

OMAHA, Neb. (AP) — The Douglas County prosecutor has charged a Fremont man with misdemeanor motor vehicle homicide for a September crash that killed another man.

A news release from Douglas County Attorney Don Kleine says 21-year-old Gregory Swatzell was driving a trailer truck in on state Highway 36 on Sept. 11 when he ran a stop sign and hit a sport utility vehicle, killing its driver, 36-year-old Ryan Boelman of Bennington.

The misdemeanor charge carries a penalty of up to a year in jail and a $1,000 fine.

Swatzell’s arraignment date has not yet been set.

LINCOLN, Neb. (AP) — Two Lincoln nonprofit health providers are planning to combine their operations to form a medical clinic that’s expected to open next December.

The Health 360 Clinic, which will provide primary health care and behavioral health services, will be inside a former office supply store in Lincoln.

Lutheran Family Services of Nebraska and the People’s Health Center say they chose that site because of its proximity to public transit, downtown area and schools.

The nonprofits are planning to open a smaller clinic in the Lutheran Family Services’ offices. That clinic will begin offering its services in January and will continue to operate until the larger clinic opens in 2015.
