The man was standing outside his North Side home when crews arrived about 2:45 a.m. Tuesday.

Feds Propose $7K in Fines for Circus Hair-Hanging Incident

ringling-brothers-human-chaPROVIDENCE, R.I. (AP) — Federal workplace safety regulators have proposed fining Ringling Bros. and Barnum & Bailey Circus $7,000 for an accident during a hair-hanging stunt that seriously injured eight acrobats in Rhode Island.

The proposed fine announced Tuesday by the Occupational Safety and Health Administration is the maximum allowed by law.

The acrobats were injured May 4 when a carabiner clip snapped, sending them plummeting 15 feet to the floor. A ninth worker, on the ground, was also hurt.

OSHA says the carabiner was overloaded in violation of industry practice and manufacturer instructions.

The circus’ parent company has 15 days to either pay the fine or contest it.

A spokesman says the circus disagrees with some of OSHA’s findings and has not yet decided whether to appeal.

Nebraska Man Gets Prison for Shooting Eagle, Hawk

bald-eagle-shotLINCOLN, Neb. (AP) — A Nebraska man convicted of shooting a bald eagle and a rough-legged hawk earlier this year has been given eight months in prison.

U.S. Attorney Deborah R. Gilg said Monday that 45-year-old Lamar Bertucci’s sentence will be followed by one year of supervised release. He was also ordered to pay $6,500 in restitution.

Bertucci pleaded guilty this year to violating the Bald and Golden Eagle Act and the Migratory Bird Treaty Act. He is accused of shooting the bald eagle in February. An investigation into his activities yielded the rough-legged hawk.

Bertucci had objected to the method used for valuing the birds. A report placed a $10,000 value on the bald eagle and $1,750 on the hawk. In the end, a judge determined $6,500 in restitution.

OMAHA, Neb. (AP) — The former doctor accused of killing four people with ties to an Omaha medical school is challenging his arrest and some of the initial searches police conducted.

Attorneys for Anthony Garcia, or Terre Haute, Indiana, argued Monday the arrest was improper because the warrant wasn’t issued until several hours afterward.

Prosecutors defended the warrants, and they maintain all the affidavits filed in court were valid.

Garcia is charged with first-degree murder in the 2008 deaths of the 11-year-old son of Creighton University pathologist William Hunter and the family’s housekeeper, as well as the May 2013 deaths of Creighton pathologist Roger Brumback and his wife.

Authorities say Garcia was motivated by revenge for being fired from Creighton’s pathology department in 2001. He has pleaded not guilty.

Nebraska County Treasurer Wants State DMV Online Fee Review

dmvLINCOLN, Neb. (AP) — A southeastern Nebraska county treasurer wants state officials to be more transparent about fees charged to people who make payments on the Department of Motor Vehicles website.

Lancaster County Treasurer Andy Stebbing said his office charges a lower convenience fee to people who use credit or debit cards in person or over the phone compared to people who make payments on the state’s DMV website. Stebbing says his office charges 2.49 percent as a convenience fee, while the state’s website charges a 3 percent fee.

He also says that the state charges a flat $3 fee to customers who make online payments using electronic checks. Stebbing says his office charges half of that.

Stebbing recently sent a letter to Nebraska’s Secretary of State, requesting he order a review of the convenience fees.
