Nebraska High Court Upholds Child Sex Conviction

OMAHA, Neb. (AP) — The Nebraska Supreme Court has upheld the child sexual assault conviction of an Omaha man who had objected to a court reporter’s covert efforts to correct a faulty trial transcript.

Charles Kays was sentenced in 2011 to up to 20 years in prison for sexually abusing a prepubescent girl.

On appeal, Kays’ attorney noted mistakes with the official trial transcript — including that 13 jurors instead of 12 deliberated the case. The court reporter corrected the mistakes, printed a new version and shredded the original — without the approval of a judge, as required by law.

The Nebraska Court of Appeals last year upheld Kays’ conviction, and he appealed to the Nebraska Supreme Court. On Friday, the high court upheld the appeals court’s finding.

ACLU Threatens to Sue Lincoln Over Arena Policy

aclu-nebOMAHA, Neb. (AP) — A civil liberties group is threatening to sue the city of Lincoln over a new written policy limiting leafleting and other public commentary outside the city’s new arena.

The Nebraska chapter of the American Civil Liberties Union said Thursday it is considering a lawsuit over the policy, which was posted on the Pinnacle Bank Arena website earlier this week. It forbids leafleting, signature gathering and picketing in outdoor areas around the arena up to public sidewalks around the building, unless allowed by an arena tenant.

The policy comes after the March arrest of 77-year-old Larry Ball, who had been handing out religious pamphlets outside the arena. Police say Ball ventured beyond barricades despite several warnings, but Ball insists he was in a public area.

Charges against him were later dropped.

Nebraska Teacher Pleads Guilty in Teen Booze Case

PAPILLION, Neb. (AP) — A 50-year-old suburban Omaha teacher accused of serving alcohol to minors has made a plea deal.

Online court records say Ann Urwiler pleaded guilty on Thursday to contributing to the delinquency of a child. Sarpy County prosecutors dropped a charge of procuring alcohol for a minor in exchange for her plea. The records say her husband, 48-year-old Jon Urwiler, made the same deal and also pleaded guilty.

Sentencing for the Urwilers is scheduled for Dec. 4. They live in Papillion (puh-PIHL’-yuhn). Police say officers saw teenagers fleeing from a party at the Urwiler home in July.

A school district spokeswoman said Friday that Ann Urwiler quit in September. Urwiler had been a first-grade teacher at Papillion’s Trumble Park Elementary School.

Police: Lincoln Man Leads Officers on Foot Chase

lincoln-policeLINCOLN, Neb. (AP) — Lincoln police have arrested a man who they say escaped from officers after being handcuffed at an elementary school.

The 32-year-old man was visiting his daughter at Prescott Elementary School when officers attempted to make the arrest. The man was wanted for questioning in a disturbance and a theft from earlier in the month.

Officers say he broke free while being escorted to the police car and they chased him on foot. They set up a perimeter and a K-9 unit later found the man hiding in an area garage.

He was cited for escape, criminal mischief and trespassing.

Lincoln Man Arrested in Girlfriend’s Death

fatal-motorcycle-crashLINCOLN, Neb. (AP) — Lincoln police have arrested a 21-year-old man in connection to a motorcycle crash that killed his girlfriend.

Officer Katie Flood tells said the man was jailed Wednesday on suspicion of manslaughter. Police say he was driving a motorcycle at 80 mph in a 40 mph zone with his girlfriend as a passenger on July 19. They say he ran a red light and crashed into a Jeep.

His girlfriend died at the scene of the crash. He was treated at an area hospital and released.

It’s unclear why he wasn’t arrested sooner.

2 Injured in Eastern Nebraska Tractor Crash

colfax county sheriffRICHLAND, Neb. (AP) — Authorities in eastern Nebraska say two people have been hospitalized after a car collided with a tractor pulling a grain wagon.

The Colfax County Attorney’s Office says an 18-year-old woman was driving on U.S. Highway 30 near Richland on Thursday. Authorities say she struck the wagon from behind and her car rolled on top of it.

Both drivers were transported to a Schuyler hospital. Their conditions weren’t reported but authorities say their injuries aren’t life threatening.

Judge Asked to Toss Lawsuit Against Iowa Agency

lawsuit-settlementOMAHA, Neb. (AP) — The Attorney General’s office has asked a judge to dismiss a wrongful-death lawsuit filed by the estate of an Omaha boy strangled by his mother in 2009.

On Wednesday, the office asked a judge to grant a motion for summary judgment, which would effectively throw out the lawsuit against the state’s health and human services department.

The suit claims the agency failed in acting on repeated warnings from the 12-year-old boy’s mother and other family members about his welfare.

Douglas County judge Mark Ashford took the motion under advisement.

Authorities found Michael Belitz’s decomposed body in a bathtub of water and cat litter. His mother, Angela Manns, admitted to strangling him with a phone cord. She pleaded no contest to second-degree murder of her son.

Hershey Settles with Colorado Edible Pot Company

Colorado-MarijuanaDENVER (AP) — A Colorado marijuana company must recall or destroy its pot-infused edibles that resemble iconic Hershey treats as part of a settlement agreement with the chocolate company.

The Hershey Co. filed a federal trademark infringement lawsuit in June against TinctureBelle LLC and TinctureBelle Marijuanka LLC. The lawsuit alleged that TinctureBelle’s Ganja Joy, Hasheath, Hashees and Dabby Patty too closely resembled Hershey’s Almond Joy, Heath, Reese’s peanut butter cups and York peppermint patty candies, respectively.

The Denver Post reports that a settlement reached in September requires TinctureBelle to stop using those names and Hersey’s brown, yellow and orange coloring for its products.

The company says in court filings that it stopped making edibles that mimic Hershey candy before the lawsuit was filed. Hershey says the edibles’ packaging confused consumers, including children.

Authorities: Woman Jumped with Kids, Killing 1

police-lights-redLYMAN, N.H. (AP) — A 29-year-old New Hampshire woman has been charged with murder and assault for jumping out a second-story window with her 4-month-old twins, killing her son and severely injuring her daughter.

Patina Welch, of Lyman, is expected to be arraigned Thursday afternoon on second-degree murder and first-degree assault counts.

Assistant Attorney General Stacey Pawlik said Thursday that Welch jumped out the window June 18 and landed on top of the boy. His twin sister is recovering.

Prosecutors say police received a 911 call from a couple in Lyman, a town of 550 people in northwest New Hampshire, reporting their son was in medical distress.

Welch does not yet have a lawyer and there is no phone listing for her.

Grand Island Delegation Lobbies for Veterans Home

NE-Veterans-HomeGRAND ISLAND, Neb. (AP) — Three members of a local delegation have returned from a lobbying trip to Washington, where they told federal officials the Grand Island Veterans Home should be remodeled instead of giving way to a new home in Kearney.

Mayor Jay Vavricek (vav-RAH’-chehk), Hall County Supervisor Pam Lancaster and veterans service officer Don Shuda (SHOO’-duh) traveled to Washington last week. They handed out booklets with a letter requesting that the federal officials “intercede in behalf of Nebraska veterans and request that the VA Secretary Robert A. McDonald deny funding for the relocation of the Grand Island Veterans Home.”

Gov. Dave Heineman’s announcement that the Grand Island facility would be replaced by the Kearney project drew protests from Grand Island and Hall County.
