24 Rescued from Maryland Roller Coaster

ambulance-lightsUPPER MARLBORO, Md. (AP) — Authorities say 24 people stranded on a roller coaster have been rescued from near the top of the ride at Six Flags America in Maryland.

Prince George’s County Fire officials say it took about five hours Sunday to rescue 17 adults and seven children from The Joker’s Jinx roller coaster.

Assistant Fire Chief Paul Gomez says the riders were sitting upright. A few had cramps, back pain and dehydration, but there were no major injuries.

A Six Flags America spokesman said in a statement that it is not yet clear what caused the ride to stop but that it has a computerized safety system that “performed as it is designed to.”

Six Flags’ website says the ride goes 60 miles per hour and upside down four times.

The search continued Monday morning along the river south of the park.

An investigation is continuing.

Lincoln Indian Center Plans $12M New Headquarters

lincoln-indian-centerLINCOLN, Neb. (AP) — Officials are looking to expand a Lincoln facility that serves Native Americans.

Lincoln Indian Center officials want to build a new $12 million, 46,000-square foot facility and renovate their current headquarters. If it moves forward, the new building would be built west of the current center.

The new center would include a gymnasium, cultural center and administrative offices.

Indian Center executive director Clyde Tyndall says employees have outgrown the current facility, built in 1980. The old building would be used for nonprofits that may want to lease space.

Tyndall says officials will apply for a $3 million federal tax credit to help pay with the project. They also hope they hope to secure a $3 million bank loan and $6 million in grants.

Nebraska Judge Says Man’s Texts Disturbed Peace

judgeshipLINCOLN, Neb. (AP) — A southeastern Nebraska judge has ruled that a Kansas man’s angry texts to his ex-girlfriend were enough to convict him of disturbing the peace.

20-year-old Kyle Hudlin, of McPherson, Kansas, had appealed after being found guilty last year of the misdemeanor count. He had argued that his texts were protected under his constitutional right to free speech.

But this week, Lancaster County District Judge Stephanie Stacy upheld the conviction and $250 fine. The judge said that while the texts they didn’t contain direct threats of violence, they did contain “angry, profane, insulting and abusive language.” That’s enough to convict someone of disturbing the peace under Nebraska law.

Nebraska Supreme Court Dismisses Man’s Appeal

ne-supreme-courtLINCOLN, Neb. (AP) — The Nebraska Supreme Court has dismissed the appeal of a 48-year-old man sentenced to life in prison as a teenager for kidnapping a Blair doughnut shop clerk in 1983.

Brian Smith was 16 when he and a teenage friend robbed the shop and kidnapped 21-year-old clerk Mary Jo Hovendick. Police say the teens raped the woman, tied her up in the car and pushed it into the Missouri River. Hovendick’s body was found months later.

Smith pleaded guilty to burglary and kidnapping and was sentenced to life.

He recently appealed based on a 2010 U.S. Supreme Court ruling that declared life sentences for juveniles in non-homicide cases unconstitutional.

But the Nebraska Supreme Court said Friday that Smith should have filed a writ of habeas corpus claiming unlawful imprisonment.

Nebraska High Court Rejects Killer’s Challenge

LINCOLN, Neb. (AP) — The Nebraska Supreme Court has rejected a killer’s appeal challenging the use of “shot-spotter” technology that records gunfire, pinpoints its origin and notifies police of it.

Thylun “Jay” Hill, of Omaha, is serving life after being convicted in 2013 of first-degree murder the February 2012 shooting death of Anthony Carter.

Hill argued in his appeal that evidence from the shot-spotter system should not have been admitted at his trial. He questioned whether the system had been properly tested and if police improperly relied on information it provided.

The high court dismissed those arguments Friday as “somewhat dubious,” saying officers reported hearing the gunshots at the same time the system recorded them and that Carter was found at the location pinpointed by system.

Governor Denies Parole to Manson Follower Davis

bruce-davisLOS ANGELES (AP) — Gov. Jerry Brown has reversed a parole board and denied the release of a former Charles Manson follower who has served more than 43 years in prison.

It was the third time a California governor denied the release of 71-year-old Bruce Davis.

The parole board found in March that he was suitable for parole based on his conduct in prison — he earned a doctoral degree while in prison and ministers to other inmates — and other factors.

Brown lauded Davis for his efforts to improve himself. However, he wrote in his decision that the evidence shows Davis “currently poses an unreasonable danger to society if released from prison.”

Davis was convicted with Manson and others in the 1969 murders of a musician and a stuntman.
