Hearing Set for Man Charged in Omaha Killings

OMAHA, Neb. (AP) — A former doctor accused of killing four people with ties to an Omaha medical school will have a preliminary hearing Thursday on a separate charge of attempted burglary.

Prosecutors say forensic evidence links Anthony Garcia to an attempted break-in in May 2013 at the home of a Creighton University Medical School professor.

Garcia, of Terre Haute, Indiana, is also charged with first-degree murder for the 2008 deaths of the 11-year-old son of Creighton University pathologist William Hunter and the family’s housekeeper, as well as the May 2013 deaths of Creighton pathologist Roger Brumback and his wife.

Authorities say Garcia was motivated by revenge for being fired from Creighton’s pathology department in 2001. He has pleaded not guilty.

Nebraskan Fights Possible Return to Prison

jailLINCOLN, Neb. (AP) — A 57-year-old Lincoln man has gone to court to keep from being sent back to prison because state officials had miscalculated his sentence.

Bruce Caton filed his action on Tuesday, asking a judge to reduce his sentence to 10 years.

He was released in October, having served 10 years of his sentence of 10 to 20 years. But he wasn’t put on parole, because officials thought he’d served his full sentence. Now officials say he should have served five more years before discharge.

Caton is among dozens of prisoners mistakenly released early. Prison officials didn’t correctly calculate sentences for at least 101 inmates.

State officials are discussing legal steps needed to retrieve the inmates.

Omaha Police: Wounded Man Found After Break-In Died at Hospital

omaha-policeOMAHA, Neb. (AP) — Omaha officers who were sent to a call about a break-in have found a fatally wounded man.

Police say the officers were dispatched about 11:40 p.m. Wednesday to a home in northeast Omaha. They found the wounded man inside the home. He died later at an Omaha hospital.

Police identified him as Timothy Marzettie, of Omaha. Other details about the shooting haven’t been released.

No arrests have been reported.

Nebraska Homestead Files Have Been Digitized

UNLLINCOLN, Neb. (AP) — A project to digitize Nebraska homesteading case files has been completed after a decade of planning, preparation and execution.

The University of Nebraska-Lincoln says the nearly 77,000 files contain more than 1.6 million digital images. The database can be searched and viewed for free at Homestead National Monument of America near Beatrice, UNL libraries, National Archives and Records Administration research centers nationwide and Family History Centers at several locations across the country.

The records are documents filed by homesteaders. They describe property improvements, including houses constructed, wells dug, crops planted, trees cleared and fences built. The case files also include records of military service and evidence of naturalization.

The records were used to ensure that those who claimed land through the Homestead Act of 1862 met the law’s requirements.

Traffic Stop in Seward County Leads to Heroin Seizure

heroinA traffic stop for speeding on Interstate 80 in Seward County led to one arrest and the seizure of two pounds of heroin.

Just before 11:30 a.m., Wednesday, June 25, a trooper stopped an eastbound 2007 Dodge Charger for speeding just west of the Beaver Crossing exit on I-80. The trooper was given consent to search the vehicle. The search led to the seizure of two pounds of heroin. The heroin, concealed under the center console, was contained in three packages and has an estimated street value of $360,000.

The driver and lone occupant of the vehicle, Joe T. Bolanos, 31, King City, Calif., was lodged in the Seward County Jail on Possession of a Controlled Substance with Intent to Deliver.

Man Dies Minutes After Being Sentenced to Jail

odd-newsCLEVELAND (AP) — Authorities in Cleveland say a man collapsed and died outside a courtroom minutes after a judge sentenced him to 60 days in jail for trying to restrain and kiss a 14-year-old girl.

The coroner’s office was expected to determine why 51-year-old Miguel Aybar died Wednesday morning.

Aybar was in handcuffs when he slumped to the floor in the hallway outside the courtroom.

Judge Michelle Denise Earley had sentenced Aybar after he was found guilty of a third-degree misdemeanor charge of unlawful restraint. He was accused of restraining the 14-year-old girl and trying to kiss her on the mouth.

Lincoln Man Injured in Crash on Pawnee Lake

Nebraska_game_and_parksLINCOLN, Neb. (AP) — An 18-year-old Lincoln man was injured when the personal watercraft he was riding collided with a motorboat on a Lancaster County lake.

The Nebraska Games and Parks Commission says the crash happened Tuesday evening at Pawnee Lake.

Nicholas Esparza was riding the watercraft on the lake’s west side when he hit the side of a boat operated by 65-year-old Fred Schlegel, of Lincoln.

Esparza, who was wearing a life jacket, was found unconscious, floating face-down in the water.

Occupants of Schlegel’s boat pulled Esparza from the water and took him to a boat ramp.

Esparza was taken to a Lincoln hospital, where he was treated for a concussion, three broken ribs, pierced lung and facial cuts.

The Nebraska Games and Parks Commission and sheriff’s office are investigating the crash.

NSP Investigates Body Found in Seward County

state-patrol-logoThe Nebraska State Patrol is investigating the discovery of a body just south of the town of Beaver Crossing in Seward County.

Just before 1:00 p.m., the Nebraska State Patrol responded to reports from the Seward County Sheriff’s Office of a male body lying along the bank of the Big Blue River, south of the bridge, off of 406th Road in Seward County.

A cause of death has not been determined and an autopsy has been ordered by the Seward County Attorney. The name of the deceased is unknown at this time.  The investigation continues.

Nebraska Dentist Charged with Stealing Gold

ne-supreme-court-gavelOMAHA, Neb. (AP) — Federal prosecutors have charged a Lincoln dentist with stealing nearly $17,000 worth of precious metals from the Veterans Affairs Medical Center in Omaha.

Prosecutors say Randall Toothaker had been working in the hospital’s dental prosthetics office before the alleged theft last summer.

A lab technician reported seeing the 57-year-old dentist open a locked cabinet where precious metals used in dental procedures, including gold, were kept.

While VA officials investigated the missing metals, prosecutors say Toothaker tried to leave the property. Officers pulled him over and found the missing metals in a bag in his vehicle.

Toothaker told officers he didn’t know how the metals got into his bag.

Toothaker’s initial appearance in federal court is scheduled for July 18. His attorney didn’t immediately respond to a message Wednesday.

Fremont Man Issued Citation Following Fatal Crash

douglas-county-sheriffWATERLOO, Neb. (AP) — The Douglas County attorney’s office has cited a Fremont man who was driving a pickup truck that hit and killed a motorcyclist last month.

The Douglas County Sheriff’s Office announced Wednesday that 30-year-old Jonathan R. Mumm voluntarily came to the sheriff’s office, where he was issued a misdemeanor citation charging him with motor vehicle homicide. He was then released.

The citation followed a May 30 crash in western Douglas County that killed Scott C. Petersen, a 37-year-old off-duty Omaha firefighter.

An investigation indicated a pickup truck driven by Mumm crossed the center line of the roadway, causing the crash.

A telephone call left with Mumm wasn’t immediately returned.
