Man Injured in Omaha Industrial Accident Sues

lawsuit-settlement(AP) — A man injured in an industrial building collapse in Omaha that killed two workers earlier this month is suing the company and its owner and president.

An attorney for Tomas Balderas, of Omaha, who was hurt in the Jan. 20 collapse of the International Nutrition plant, says the lawsuit is really an effort to find out what caused the accident.

The lawsuit, which was filed Tuesday, says the company and its owner and president, Steven Silver, should have been aware of the dangers that led to the accident. But Pearson says he doesn’t know what caused the building to collapse. He says he’s hoping the discovery process required by the lawsuit will uncover any federal Occupational Safety and Health Administration violations that could have caused the accident.

York Man Who Shot at Deputy Gets 7-9 Years

(AP) — A York man who was wounded in a gunshot exchange with a deputy has been sentenced to prison.

26-year-old Max McCall was sentenced on Tuesday. Judge James Stecker gave him two to four years for attempted assault of an officer and one to two years for trying to flee from arrest. Those terms are to be served at the same time and then followed by a five-year sentence for using a firearm to commit a felony. McCall had pleaded no contest to the three charges after prosecutors dropped other charges.

The incident occurred Aug. 11, after the deputy responded to a call about McCall threatening a relative. Prosecutors say McCall was shot after he fired at the deputy.

Police ID Woman Killed in Lincoln Crash

lincoln-police(AP) — Authorities have released the name of a 53-year-old woman who died after a Lincoln accident that involved three vehicles.

The woman was identified Wednesday as Teresa Michaud. Police say she probably suffered a medical emergency before the crash.

Police say Michaud was driving east when her car crossed a median around 5:30 p.m. Tuesday, hitting a sport utility vehicle and then ramming into another car.

Michaud was pronounced dead at the scene. Three other people injured in the collisions were taken to a Lincoln hospital.

The accident is still being investigated.

Man Gets Life Sentence in Fatal Omaha House Fire

terrance-hale(AP) — A man convicted in the death of an elderly man following a house fire in north Omaha has been sentenced to life in prison.

A judge issued the sentence Wednesday for 31-year-old Terrance Hale. He was convicted of first-degree murder in November.

Prosecutors say Hale broke into the Omaha home of 83-year-old Raymond Vasholz and his wife, Elizabeth Vasholz, before attacking them and setting several fires throughout the house.

Raymond Vasholz was killed and Elizabeth Vasholz was injured.

Defense attorneys argued that Hale tried to help the couple escape the fire.

2 Killed Following 3-Vehicle Crash Near Blair

fatal-crash(AP) — Authorities say two women have been killed following a three-vehicle crash near Blair in eastern Nebraska.

Washington County Sheriff Mike Robinson says a vehicle southbound on Highway 133 crossed the center line Wednesday morning and sideswiped a northbound car. The southbound car ended up in the northbound lanes and collided head-on with a third vehicle.

29-year-old Sara Jorgenson and 47-year-old Joanne Roche were killed. Both women were from Kennard.

Fifty-two-year-old Helen Langdon and 74-year-old Ronald Roche were injured and taken to area hospitals. Information about their conditions has not been released.

Cali. Boy, 14, Surrenders After Shooting of Sister

crime-scene-police-shoot(AP) — Police in California say a 14-year-old boy wanted in connection with the shooting death of his older sister has turned himself in.

Oakland police spokeswoman Officer Johnna Watson said Wednesday that the teen was accompanied by several family members, including his father, when he surrendered at Oakland police headquarters. Watson says he is being interviewed by detectives.

Police say the boy is suspected of fatally shooting his 17-year-old sister, who is the mother of a toddler, on Jan. 23 inside an apartment building in Oakland’s Chinatown neighborhood.

The boy’s father had publicly pleaded with the teen, who was considered armed and dangerous, to turn himself in. His surrender came after investigators spent hours talking to his family and friends.

The Associated Press normally doesn’t name minors suspected of crimes.

Neb. Medicaid Backers Pack Legislative Hearing

ne-legislature-13(AP) — Supporters of a new bill to expand Medicaid in Nebraska are calling on lawmakers to act on the proposal this year.

Advocates packed a legislative hearing on Wednesday to voice support for the proposal, an optional piece of the federal health care law. A similar measure was blocked last year.

Sen. Kathy Campbell of Lincoln says the bill would give working, low-income Nebraskans better access to quality health care. The federal government has promised to pay at least 90 percent of the costs for newly eligible residents.

Department of Health and Human Services CEO Kerry Winterer says the bill would increase the cost of the state’s current Medicaid program, which covers an average of 241,000 individuals a month at a yearly cost of $1.8 billion.

Authorities Battle Large Brush Fire in Omaha

OMAHA-FIRE-AND-RESCUE-BADGE(AP) — Authorities are battling a large brush fire near a recreational lake in north Omaha.

Multiple fire crews are working to contain the blaze, which began late Wednesday afternoon near Glenn Cunningham Lake.

The station reports no structures are immediately in the path of the fire. No injuries have been reported.

Omaha television station WOWT says the fire as spread to multiple trees in the area, and motorists have reported seeing smoke in the air for several miles.

Authorities have not released additional information.

NSP Seizes 44 Pounds of Weed Near Lincoln

POT-BUSTA traffic stop for speeding on Interstate 80 near the 27th Street Exit, in Lincoln, Lancaster County, led to the arrest of two California residents and the seizure of 44 lbs. of marijuana.

Around 10:30 a.m., Tuesday, January 28, a trooper initiated a traffic stopped of an eastbound, 2012 Toyota Prius, after an NSP aircraft clocked the vehicle traveling 81 mph in a 65 mph zone.  A check of the driver’s operating license indicated he was wanted on an outstanding warrant out of California.  Upon contacting the passenger in the vehicle, the trooper smelled a strong odor of marijuana.  A probable cause search of the vehicle led to the seizure of 44.3 lbs. of marijuana. The marijuana was contained in three duffel bags in the rear cargo area of the vehicle.

The driver, David J. Azaria, 23, Los Angeles, Calif., and a passenger in the vehicle, Christophe J. Clasquin, 21, Beverly Hills, Calif., were both lodged in the Lancaster County Corrections, each on a charge of Possession of Marijuana with Intent to Deliver.

Sex Offender Gets 30-40 Years in New Omaha Case

sex-offenders(AP) — A 51-year-old registered sex offender in Omaha has been returned to prison for another child sex crime.

Online court records say Harold Shipley Jr. was sentenced on Tuesday to 30 to 40 years in prison. Records say Shipley had sexually assaulted a girl several times starting in August 2012. The records also say Shipley enticed three children into his apartment on the east side of Omaha on Feb. 26 last year and molested a 7-year-old girl.

Shipley pleaded guilty to attempted sexual assault of a child after prosecutors lowered the charge and dropped four others.

Shipley is listed on the Nebraska Sex Offender Registry. He was convicted in 1998 of sexually assaulting a child and was released from prison in 2000.
