Nebraska Man Found Dead in Missouri River

south-sioux-city(AP) — Authorities don’t suspect foul play in the death of a man in his 80s who was found dead in the Missouri River near a campground in northeast Nebraska.

The man’s body was found Wednesday.

South Sioux City Police Chief Scot Ford says rescue boats helped recover the man’s body near the Scenic Park campground.

Ford said Thursday that the family requested that the man’s identity not be released.

Ford says it doesn’t look like the man had been boating or fishing before his death, but there’s no indication of criminal activity.

South Sioux City Parks Manager Gene Maffit says the man wasn’t registered as a guest at the campground.

Federal Appeals Court Rejects Appeal of Nebraska Brothers

federal-court-of-appeals(AP) — A federal appeals court has upheld the conspiracy and theft convictions of two Nebraska brothers in a Social Security fraud case.

Timothy Shirley was sentenced last year to 21 months for conspiracy, theft and Social Security fraud. His brother, Matthew Shirley, was sentenced to 12 years for conspiracy and theft.

Prosecutors said Matthew Shirley employed his brother — paying him in cash — knowing his brother was receiving Social Security disability benefits.

The 8th U.S. Circuit Court of Appeals on Thursday rejected Matthew Shirley’s argument that he stole nothing, because disability payments come from a trust fund that belongs to the individual who funds it, not the U.S. government.

It also rejected Timothy Shirley’s claims that there was insufficient evidence to conviction him and that his sentence was excessive.

 

Australian Man Gets Prison Time for Wyoming Bank Heist

corey-donaldson(AP) — A federal judge in Wyoming handed down a nearly six-year prison sentence to an Australian man who says he robbed a Jackson bank so he could give money to the homeless.

The judge on Thursday sentenced 40-year-old Corey Donaldson to 70 months for bank robbery.

Donaldson claimed at sentencing that he was justified in robbing more than $140,000 from the US Bank in Jackson on New Year’s Eve.

He has likened himself to Robin Hood and claims he gave much of the money to the homeless and staged the robbery to call attention to problems with the banking system.

Law enforcement officers arrested Donaldson in Utah and recovered more than $30,000 from him and from a room he rented in an upscale hotel.

Officials Capture Inmate Who Escaped in Lincoln

(AP) — Corrections officials say they’ve captured a Nebraska inmate who escaped after a work detail assignment.

The Nebraska Department of Correctional Services says they located 33-year-old Juan Ramirez Thursday afternoon about two hours after he escaped.

Ramirez had been at a work detail site before being transported by vehicle to the Community Corrections Center in Lincoln. Officials say he opened a car door on the way to the center and ran.

Ramirez is serving between 10 and 15 years for two counts of possession of a stolen firearm and one count of burglary.

Police Investigating Burglary at Bellevue East High School

bellevue-east(AP) — Authorities are investigating an early morning burglary at a Bellevue high school.

Bellevue police say two suspects broke into Bellevue East High School early Thursday morning and obtained keys from an administrative office. The suspects used the keys to enter other offices.

Three laptops, a camera and an undetermined amount of money was taken. Officials estimate $20,000 in damage to the school.

Police are reviewing a security camera in an effort to identify the two people.

Man Dies After Hanging Himself in Beatrice Jail

jail(AP) — A 30-year-old man who hanged himself in a Beatrice jail cell has died in a Lincoln hospital.

The Gage County Attorney’s Office says Chad Gesin died Tuesday morning. An autopsy has been ordered, and a grand jury will be investigating. State law requires such investigations whenever someone dies in custody or while being arrested.

Gesin had been arrested on suspicion of domestic assault and assault around 5:15 p.m. on July 4. A court document says two officers had seen Gesin punch another man in downtown Beatrice. A woman who had been talking to Gesin told the officers that Gesin had earlier grabbed her neck when they were at a convenience store.

Authorities say Gesin hanged himself not long after he was put in a cell at the Gage County Jail.

Shane Osborn Kicks off Senate Campaign in Grand Island

(AP) — Former Nebraska State Treasurer Shane Osborn will be in Grand Island on Thursday to kick off his Republican candidacy for U.S. Senate and a campaign tour of the state.

Osborn is seeking to replace outgoing GOP Sen. Mike Johanns, who is not running for re-election in 2014.

Osborn will be introduced Thursday by his wife, Stacie. Speakers will include two crew members from Osborn’s 2001 surveillance mission, when a Chinese fighter jet collided with Osborn’s plane. Osborn successfully landed his crippled plane on a Chinese island, and he and his 23 crew members then spent 11 days in captivity before being released.

Following his Grand Island appearance, Osborn will travel to Columbus and Norfolk before touring other communities across the state in the coming days.

Matt Damon Creates a Stir at UNL

matt-damon-at-unl(AP) — The man in the gray T-shirt and blue ball cap sported a name tag that said “M. Damon” and created a stir as he toured the University of Nebraska-Lincoln campus.

It was megastar movie actor Matt Damon, who first gained movie fame as a troubled math genius working as a janitor at the Massachusetts Institute of Technology.

Damon told well-wishers that he was in Lincoln on Wednesday to attend New Student Enrollment Day with his nephew, who’d enrolled as a freshman and will start classes there in the coming fall semester.

Damon and university officials declined to give the new student’s name.

Damon said he “basically bought out” the University Bookstore while stocking up on Nebraska Cornhusker gear for his children.

San Diego Man Kills Wife with Cannon, Charged with Murder

cannon(AP) — A San Diego County judge has ruled that a man must face trial for the murder of his girlfriend with a cannon-like device.

Judge Evan Kirvin said Wednesday the prosecution had presented enough evidence for Richard Dale Fox to stand trial on charges of murder, exploding a destructive device causing death and child endangerment.

The 40-year-old faces life in prison if convicted.

Prosecutors say Fox was drinking with friends in the San Diego County town of Potrero when he set off the device, sending shrapnel into his trailer that killed 38-Jeanette Ogara. They say Ogara was Fox’s girlfriend and the mother of his 4-year-old daughter.

Defense attorney Thomas Slattery called the death a freak accident.

Fox has pleaded not guilty to all three charges.

NE Lawmakers Advised Not to Tax Business Inputs

ne-legislature-13(AP) — A sales-tax expert says Nebraska should avoid taxing equipment and raw materials that are used to produce consumer goods.

Indiana University professor John Mikesell told lawmakers Wednesday that the state should focus instead on taxing products once they’re bought for household use. Mikesell says businesses that are taxed during production pass the expense along to consumers through higher prices.

His comments came during a meeting of the Legislature’s Tax Modernization Committee, which is looking for ways to make Nebraska’s tax system fairer, more efficient and competitive.

Mikesell says a retail sales tax driven by household consumption is a better way to finance government, and does less to stifle economic growth.

He also suggested taxing food, though lawmakers say that idea is a tough sell.
