Sisters hurt on Kansas waterslide that killed boy reach deal

Schlitterbahn-Water-ParkKANSAS CITY, Mo. (AP) — Two sisters injured in a Kansas waterslide accident that killed a state lawmaker’s 10-year-old son have reached a settlement with the water park’s owner.

Attorney Lynn Johnson on Wednesday confirmed the out-of-court deal with the Schlitterbahn park over the “Verruckt” slide accident last summer.

Johnson wouldn’t reveal details of the settlement. The sisters’ names haven’t been publicly released.

Authorities said Caleb Schwab was killed and the sisters injured last Aug. 7 while riding the Verruckt, which was billed as the world’s tallest waterslide. That ride has since been closed, and a Schlitterbahn spokeswoman says it will be demolished as soon as a court rules it’s no longer needed for evidentiary purposes.

Schwab’s family reached a settlement in January with Schlitterbahn and the raft’s manufacturer.

Lack of sewer funding delays Omaha development

omahaPAPILLION, Neb. (AP) — A lack of drainage infrastructure is blocking progress and growth in one of the few places still available for development in Omaha’s metropolitan area.

The Legislature on Thursday will debate state Sen. Sue Crawford’s bill aimed at making it easier to pay for a sewer system that would be built in stages and eventually cost $220 million.

The bill would allow cities and villages to form a public agency with a county to manage an entire region’s sewer system.

There’s a push for legislation as Sarpy County prepares for the construction of a freeway, which would cross the southern portion of the county that currently lacks sewers.

The first phase of sewage work would begin in 2019 should the bill pass.

Lincoln woman charged with sexually assault teenage boy

LINCOLN, Neb. (AP) — A 46-year-old Lincoln woman has been charged with sexually assaulting a 15-year-old boy.

Sunny Gibbons was arrested Thursday and charge with first-degree sexual assault of a child. If convicted, she faces 20 years to life in prison.

Police began investigating after the boy, who is now 16, told a school official that Gibbons performed sex acts with him last year on two different occasions.

Gibbons remained jailed Tuesday in lieu of $750,000 bail. Her public defender has asked the court for a bond reduction. That hearing is set for Wednesday.

Gibbons’ public defender did not immediately return a phone message Tuesday seeking comment.

Parking changes announced at Omaha’s Eppley Airfield

eppley-jetOMAHA, Neb. (AP) — Changes have been announced at Omaha’s Eppley Airfield as crews prepare to build a new six-story parking structure.

Eppley will close its surface and canopy lots on Thursday to prepare for the construction.

The new parking structure, which will hold 3,000 cars, was approved by the Omaha Airport Authority in December.

The $66.5 million project is scheduled to begin in May and take about two years to complete.

During that time, rental car operations at the airport will be relocated to the canopy lot south of the terminal, which will be closed to public parking.

Man pleads guilty in Platte County crash death case

gavel-moreMONROE, Neb. (AP) — A May sentencing has been scheduled for a Columbus man convicted in a Platte County crash death.

Court records say 29-year-old Ever Gudiel-Hernandez pleaded guilty Monday to vehicular homicide in the Dec. 16 crash of his pickup truck along Nebraska Highway 22 east of Monroe. The rollover crash killed his passenger, 27-year-old Eric Guzman, of Columbus.

Gudiel-Hernandez also pleaded guilty in an unrelated drunken driving case after prosecutors amended the charges.

His sentencing is scheduled for May 22.

Lawsuit blames bad cremation unit rebuild for mortuary fire

lawsuit-settlementOMAHA, Neb. (AP) — An Omaha mortuary and its insurers have sued a Pennsylvania company, alleging that it didn’t properly rebuild a cremation machine blamed for a fire that injured four people.

The Jan. 26, 2016, blaze heavily damaged the Heafey-Hoffmann-Dworak-Cutler funeral chapel. The lawsuit was filed last month by Heafey’s corporate entity and Cincinnati Casualty Co. and Cincinnati Indemnity Co. They seek a jury trial and at least $5.75 million from Matthews International Corp., which is based in Pittsburgh. A company spokeswoman declined to comment Tuesday.

The bodies and cremains of deceased people that had been in the burning structure later were taken to other mortuaries owned by the company.

Co-owner Bill Cutler said Tuesday that the rebuilding is expected to be completed in September.

 

Nebraska’s legal options limited in Kansas prairie smoke

fireLINCOLN, Neb. (AP) — A Lincoln attorney says that Nebraska has limited legal options regarding the smoke carried into the state from Kansas ranchers who annually burn tallgrass prairie.

A group of ranchers in the Flint Hills burned upward of 2.3 million acres of North America’s largest unplowed stretch of tallgrass prairie Saturday. The burning led to complaints from neighbors in Nebraska due to southerly winds carrying the smoke into the state.

Lincoln lawyer Steve Mossman, who specializes in agricultural and environmental law, doesn’t think Nebraska could successfully sue Kansas authorities to regulate prescribed burns because courts are reluctant to force them to regulate against their will. He says a better option is cooperation and better communication between the two states.

Kansas usually burns the Flint Hills acres around March and April every year.

Man injured in Lincoln traffic stop settles lawsuit

federal-court-of-appealsLINCOLN, Neb. (AP) — A man who was injured in a Lincoln traffic stop has settled his lawsuit against the city for $160,000.

Leroy Duffie and the city agreed to terms March 30. Lawyers for both sides say their clients are pleased to settle the matter.

An 8th U.S. Circuit Court of Appeals panel ruled last August that officers didn’t have reasonable suspicion that Duffie had or was going to commit a crime when he was stopped Sept. 3, 2011. Police say Duffie’s van matched a suspect’s vehicle.

Duffie says he told officers that he had lost his legs to amputation and couldn’t immediately comply with their demands to get out of his van. He fell when he did so. His injuries required surgery.

Chief: 2 adults dead, 2 students hospitalized in San Bernardino school shooting

The San Bernardino police chief says two adults are dead after a shooting at an elementary school.

San Bernardino Police Chief Jarrod Burguan says on Twitter that investigators believe “the suspect is down.” He says there is no further threat to the school.

Burguan says the shooting is believed to be a murder-suicide.

He said at least two students were taken to a hospital.

A spokeswoman for San Bernardino City Unified school district says one of four people shot in a classroom was a teacher.

Maria Garcia says the shooting is believed to be a domestic dispute.

At least two students have been airlifted to a hospital.

The police chief of San Bernardino says a shooting at an elementary school appears to be a murder-suicide.

San Bernardino Police Chief Jarrod Burguan said on Twitter that there four victims being treated, including at least two students who were taken to a hospital.

He says the shooting happened in a classroom.

The other students in the school were being evacuated and taken to a nearby school.

A fire official says multiple people have been shot at an elementary school in San Bernardino.

San Bernardino County fire spokesman Eric Sherwin says the shooting happened Monday morning at the North Park School in San Bernardino.

Sherwin says numerous firefighters and police officers are headed to the scene.

No further information was immediately available.

Driver injured when car goes airborne, lands in Omaha lake

omaha-policeOMAHA, Neb. (AP) — Authorities say a driver was seriously injured when her car crashed into Glenn Cunningham Lake in north Omaha.

Police say the woman was driving west on Nebraska Highway 36 Sunday night when her car went out of control, left the roadway, hit a guardrail and went airborne, landing upside down in the lake.

The woman made it to shore on her own and was found by a passing motorist. The woman was taken to a hospital.

Police say the woman said she’d smoke marijuana and methamphetamine before the crash. Charges against her are pending.
