Nebraska Supreme Court Reinstates Man’s DUI Conviction

ne-supreme-courtOMAHA, Neb. (AP) — The Nebraska Supreme Court has reinstated a man’s drunken driving conviction, reversing last year’s Nebraska Court of Appeals ruling that found his constitutional rights had been violated.

The state’s high court on Friday found that a Wisner police officer was not wrong to stop 27-year-old Adam Woldt to gather information about someone else’s possible criminal activity, then used the stop to arrest Woldt for DUI.

Woldt had argued that because the officer had no suspicion that Woldt had committed a crime when he was stopped, his constitutional right to be free of unreasonable search and seizure had been violated.

But the high court said the officer’s stop of Woldt was not unreasonable and that the officer’s interest in protecting public safety outweighed his interference with Woldt’s individual liberty.

Boys Town Resident Died of Natural Causes, Authorities Say

boys-townBOYS TOWN, Neb. (AP) — Authorities say an 18-year-old whose body was found in his room at Omaha’s Boys Town died of natural causes.

On Friday a news release from the Douglas County Sheriff’s Office said an autopsy shows Larry McBryde died of cardiac dysrhythmia, or abnormal heart rhythm, associated with cardiac fibrosis, a condition that can affect the heart valves and muscle.

The body of McBryde, who was from Erwin, North Carolina, was found on the floor of his room the morning of Feb. 22. He was last seen alive around 10:45 the night before.

Boys Town was founded as an Omaha orphanage in 1917 by the Rev. Edward Flanagan and now is situated in western Omaha, serving as a residential center for troubled youth.

Charges Dismissed in Lincoln Woman’s Shooting Case

LINCOLN, Neb. (AP) — Threats and weapons charges filed against a Lincoln woman have been dismissed.

Online court records say a judge approved the prosecution motion Monday in the case against 23-year-old Elyssia Ochoa.

Lincoln police say Ochoa had driven to a friend’s apartment July 10 after her friend reported that she and her husband had been arguing. Police say Ochoa fired one rifle shot toward the man and a neighbor, hitting a sidewalk. She was arrested several days later.

Prosecutors asked for the charges to be dismissed because they couldn’t find the man and the neighbor or other witnesses.

Cops: Mom Tortured Son, 2, with Cigarette, Boyfriend Laughed

child-abuseEAST PITTSBURGH, Pa. (AP) — Police say a Pennsylvania woman tortured her 2-year-old son with at least 15 cigarette burns while her boyfriend watched and laughed.

Police have jailed 19-year-old Anna Russell and 25-year-old Enrique (en-REE’-kay) Soto on charges including aggravated assault and conspiracy.

Police say the burns were inflicted on Aug. 1 and were discovered a week later when the boy’s grandmother took him to a hospital. Doctors told police the burns were “administered deliberately, in a chronological order, over a very short period of time in one sitting.”

Police have since interviewed the boy’s 3-year-old sister who told them Russell burned the boy while Soto watched and laughed.

Online court records don’t list an attorney for the East Pittsburgh couple, who face a preliminary hearing April 19.

York Facility Staffer’s Child Fathered by Teen, Authorities Say

YORK, Neb. (AP) — Authorities say a woman who’d worked at a York facility for troubled children has given birth to a child fathered by a teenager being treated there.

Court records say 37-year-old Jamie Bishop, of Seward, is charged with sexual assault of a minor. Court documents say Bishop and the 15-year-old had sex several times in his room or on the grounds at Epworth Village from January to July last year. The child was born in December, and authorities say DNA tests prove the boy’s paternity.

Associated Press attempts to reach Bishop’s attorney Friday were unsuccessful. Bishop’s next court appearance is scheduled for May 11.

Police Release Name of Man Fatally Shot by Omaha Officer

crime-scene-police-shootOMAHA, Neb. (AP) — Omaha police have released the name of a man who was fatally shot by an officer.

Police said in a news release Friday that officers assigned to an anti-gang unit spotted the man about 4:25 p.m. Thursday. He’d fled from them earlier in the day.

Police say the officers confronted the man, and the situation rapidly escalated. One of the officers shot the man, who was taken to Nebraska Medical Center, where he later died. Police did not say whether the man had fired at the officers or otherwise assaulted them or say whether he was armed.

Police identified him as 44-year-old Lance McIntire.

Omaha Police Officer Shoots, Kills Suspect

Authorities say an Omaha police gang unit officer shot a “known suspect” Thursday afternoon in the parking lot of Sol’s Jewelry & Loan in Omaha. The shooting happened around 4:20 p.m.

The suspect was taken in critical condition to the Nebraska Medical Center where he later died.

No officer injuries have been reported.

Authorities have not released the names of those involved.

Pedestrian Dies After Being Struck by Tow Truck in Omaha

omaha-policeOMAHA, Neb. (AP) — A man has died after being struck by a tow truck in Omaha.

Officials with the Omaha Police Department say 24-year-old Jerred Zoll, of Omaha, was attempting to cross the street after stepping off a city bus Thursday when he was struck by an oncoming tow truck.

The collision happened a little before 3 p.m. near 72nd and Cass streets.

He was transported in critical condition to the Nebraska Medical Center, where he later died.

The tow truck driver was not injured.

Police say the collision remains under investigation, although speed and alcohol don’t appear to be factors in the case.

Lincoln Firefighter Hospitalized After Residential Blaze

lincoln-fire-departmentLINCOLN, Neb. (AP) — A firefighter has been hospitalized after battling a residential blaze in Lincoln.

Authorities say two residents also were treated after Thursday morning’s fire. All three are expected to survive their injuries.

The flames were contained to the second floor of the house, which had been divided into apartments.

The fire cause is being investigated.

Appeals Courts Upholds Dismissal of Lawsuit Against Nebraska

ne-court-of-appealsOMAHA, Neb. (AP) — A federal appeals court has upheld the dismissal of a lawsuit against Nebraska and various state officials that faulted them for releasing a prisoner who killed an Omaha woman and three others shortly after he got out.

A three-judge panel of the 8th U.S. Circuit Court of Appeals on Thursday upheld a district court’s dismissal last year of the lawsuit brought by the husband of 33-year-old Andrea Kruger. The appeals panel agreed that the state is immune because the release of Nikko Jenkins was discretionary and protected by law.

The 33-year-old Kruger was pulled from her car on Aug. 21, 2013, in northwest Omaha and shot four times by Jenkins. Jenkins later pleaded no contest and was convicted of four counts of first-degree murder. His sentencing is pending.
