Police: 2 Men Injured in Lincoln Shooting

lincoln-policeLINCOLN, Neb. (AP) — Police say two men have been injured in a shooting inside a Lincoln home.

Lincoln Police Department Capt. Mayde McGuire said that there was gunfire inside the home around 5:15 p.m. Thursday. McGuire said that police arrived and found a man inside the home with life-threating gunshot wounds. He was transported to a hospital.

According to McGuire, a second man who was shot drove away from the house, but was pulled over by a Nebraska State Patrol trooper on a traffic stop. Police say that man is in the hospital in critical condition.

Capt. Bob Farber said that authorities were looking for a third person possibly involved in the shooting.

The shooting remains under investigation.

Woman Whose Omaha Babysitter Was Killed to Read Statement

gavel-and-scaleOMAHA, Neb. (AP) — A woman who was at the scene of her babysitter’s murder as a child is now protesting the convicted killer’s early release.

Beth Ann Bushon will read a written statement Friday at a resentencing hearing for Christopher Garza, one of the two men serving life sentences for Christina O’Day’s murder nearly 26 year ago.

Garza, who was 16 during the 1990 murder, is eligible for a lighter sentence under a 2012 U.S. Supreme Court ruling that declared that life sentences without parole were unconstitutional for juvenile offenders. Under the ruling, judges can still impose life sentences, but they must consider other options.

Garza is one of 27 Nebraskans are being resentenced as a result of the ruling.

Jury: Smokers Didn’t Prove That Marlboros Have Defective Design

jury-boxBOSTON (AP) — A federal jury has rejected claims by a group of Massachusetts smokers who sued Philip Morris USA to try to force the cigarette maker to pay for lung cancer screenings.

The jury in its verdict Wednesday found that smokers in the class-action lawsuit didn’t prove that Marlboro cigarettes were defectively designed.

The smokers were not seeking money. Instead, they wanted Philip Morris to pay for a medical-monitoring program, including 3-D chest scans that can detect signs of early-stage lung cancer.

Philip Morris says this is the third such medical-monitoring case to go to trial, and each time, the jury has ruled in the company’s favor.

Attorneys for the smokers didn’t immediately return calls.

The judge indicated she will decide whether there was a violation of Massachusetts consumer protection laws.

Nebraska Woman Gets 18 Months for Embezzlement

dept.-of-justiceOMAHA, Neb. (AP) — A suburban Omaha woman has been given 18 months in prison for embezzling from a bank branch.

Federal prosecutors say 43-year-old Amy Fisher, of Papillion (puh-PIHL’-yuhn), must serve three years of supervised release after she leaves prison. She also was ordered to pay restitution of nearly $159,000. Fisher pleaded guilty in June.

Fisher was convicted of thefts that occurred from September 2012 through March 2014 while working at a Bank of the West branch. Prosecutors say Fisher took the money from 17 customers’ accounts.

Man Gets 10 to 20 Years in Prison for Lincoln Shooting

LINCOLN, Neb. (AP) — A man charged in a shooting that injured a Lincoln man has been sentenced to 10 to 20 years in prison.

Court records say 22-year-old Jeffery R. Wyatt Jr. was sentenced Wednesday. He had pleaded no contest to first-degree assault.

Authorities said that Wyatt shot Timothy Kuker twice in the abdomen last October on the porch of an apartment building in Lincoln. Wyatt was arrested a day later in Shelby, just south of Columbus.

Kuker remained in the hospital until he was released Jan. 4.

13 People Arrested in Lincoln During Sex Trafficking Sting

Jail-Bars-and-Cuffs_mediumLINCOLN, Neb. (AP) — Lincoln police have arrested over a dozen people as a result of a multi-state sex trafficking investigation.

Authorities say 13 people were arrested in Lincoln as a part of a sex trafficking sting conducted by a national coalition of law enforcement agencies between Jan. 17 and Feb. 7.

Police say six of the 13 people arrested in Lincoln were potential sex buyers. An additional five people were cited for prostitution and two others for pandering after driving women to hotels for prostitution.

The Lincoln Police Department worked with the Cook County Sheriff’s Office in Illinois during the investigation.

The sting included 23 law enforcement agencies across 14 states and arrested a total of 552 would-be sex buyers and 30 sex traffickers.

5 Douglas County Restaurants Closed for Not Having Permits

douglas-countyOMAHA, Neb. (AP) — Douglas County officials say five restaurants have been closed for operating without a permit.

Officials with the county health department say a food supervisor was accompanied by an Omaha police officer to issue citations to the restaurant owners and close the businesses on Wednesday. The department did not identify the restaurants that were closed.

The enforcement comes after county officials revealed Monday that they’d soon begin closing 165 food and drink businesses that don’t have permits.

The businesses were notified and reminded of expiring permits in November and January.

The closed facilities will need to pass a full inspection before they can re-open.

The release says enforcement will continue Thursday as there are roughly 50 remaining facilities that have not yet complied.

Omaha Police Arrest Man Who Fired Shots in Bar, Later at Officers

crime-scene-police-shootOMAHA, Neb. (AP) — Omaha police have arrested a 63-year-old man they say fired several shots inside a southwest Omaha bar, then retreated to a nearby apartment building where he fired more shots at officers.

The shooting at the Parliament Pub, which is located in an outdoor shopping center, happened around 2 p.m. Police spokeswoman Jessica Swanson says several people were inside the bar when the man walked in with a long gun and began shooting. Swanson says no one was shot.

Swanson says the shooter then left the bar, went into a nearby apartment and later fired shots at responding officers, but no officers were injured. Swanson says a police negotiator was able to talk the man into surrendering around 3 p.m. Wednesday.

Omaha Man Pleads Guilty to Killing Mother, Half Brother

OMAHA, Neb. (AP) — A 25-year-old Omaha man has pleaded guilty to killing his mother and his 4-year-old half brother to avoid the death penalty.

Roberto Martinez-Marinero pleaded guilty Wednesday in Douglas County District Court to two counts of first-degree murder in the May 5 deaths of 45-year-old Jesus Ismenia Marinero and 4-year-old Josue Ramirez-Marinero.

He is sentenced to a mandatory term of life in prison.

Prosecutors say Martinez-Marinero repeatedly stabbed and beat his mother in a dispute over money. He dumped her body in a ditch, left his 11-month-old half brother in a dumpster and threw his 4-year-old half brother to his death from a bridge over the Elkhorn River.

A passer-by discovered the baby after hearing noises coming from the trash bin. The boy, wearing only a diaper, suffered only bruises.

Omaha Woman Sentenced After Posting Photo of Assaulted Girl

OMAHA, Neb. (AP) — A 19-year-old Omaha woman has been sentenced to probation for posting a photo of a naked girl who had been assaulted by her brother and his friend.

Judge Greg Schatz sentenced Jalyia Templeman on Tuesday to two years of probation.

Templeman had faced up to 20 months in prison after pleading no contest to recording a juvenile in a state of undress. During the sentencing, Schatz cited Templeman’s lack of record, remorse and young age.

Templeman told Schatz that she didn’t know her brother, Javohn Templeman, and his friend, Nicholas Bregg, had repeatedly raped the 16-year-old girl. Javohn Templeman and Bregg have been convicted in the case.

Jalyia Templeman’s attorney, Molly Blazek, said her client was helpful throughout the case.
