Nebraska Court Overturns Dismissal of Train Crash Lawsuit

Union-Pacific-Coal-Train-in-ColoradoLINCOLN, Neb. (AP) — The Nebraska Supreme Court has reversed a judge’s decision to throw out a wrongful death lawsuit filed by the mother of a 13-year-old boy who was killed by a train.

The court said in a 4-2 ruling Friday that reasonable people could have reached different conclusions about who was at fault for the July 2005 crash.

Efrain Ramos-Domingo was killed when he rode his bicycle onto a double set of railroad tracks in Schuyler while the safety gates were down. The boy was struck by a westbound Union Pacific train just after an eastbound train had cleared the intersection.

A Colfax County District Court judge ruled that Union Pacific had not violated its standard of care and concluded that the boy should have looked and listened for the oncoming train.

Plans Resume for Natural Gas Pipeline in Northeast Nebraska

black-hills-energyNORFOLK, Neb. (AP) — Work has resumed on development of a 50-mile natural gas pipeline dubbed the Northeast Nebraska Line that will run from Bancroft to Norfolk.

Black Hills Energy first announced the project last year after a Houston-based company said it planned to build a manufacturing plant in Norfolk. But falling oil prices interrupted those plans.

This fall, OCT Pipe announced its plans to build and operate a manufacturing facility in Norfolk, and work on the pipeline began anew to supply OCT with natural gas.

Black Hills Energy has already determined the natural gas line’s route from Bancroft and completed preliminary reviews. Black Hills is also working with landowners along the route and expects to begin construction in the spring.
