OMAHA, Neb. (AP) — Police say a man already being held in jail on separate charges has been arrested on suspicion of the June beating death of a homeless man in Omaha.

Police say 42-year-old Kak Thoan was booked Friday on suspicion of homicide and a use of deadly weapon. Police believe Thoan bludgeoned 54-year-old Timothy Rasmussen, whose body was found on a street on June 20. Police have not said what they believe was used to beat Rasmussen.

Thoan has been held in the Douglas County jail since June 23 on separate charges of first-degree assault and robbery in the beating of another homeless man. Police say Thoan was also homeless at the time of his arrest.

A call to Thoan’s public defender seeking comment was not immediately returned Saturday.

OMAHA, Neb. (AP) — An Omaha police union, retail giant and homeless shelter are partnering to offer a shopping spree that will give presents to children and their families this holiday season.

The Omaha Police Officers’ Association will partner with Walmart and the Open Door Mission to hold “Shop with a Cop” on Thursday.

The annual event pairs 50 children from the Open Door Mission with uniformed officers to go on a holiday shopping spree.

Children will arrive at 5:30 p.m. Thursday at the Omaha Police Officers’ Association Hall, where they will be paired with an officer. They will then shop at two Walmart stores in the Omaha-metro area.

After shopping, everyone will return to the hall for dinner and a party with Santa.

LINCOLN, Neb. (AP) — A Lincoln woman has been sentenced to probation and community service for causing the death of an 81-year-old man in a traffic crash.

Laurie Clemans had been scheduled to be sentenced Friday after pleading no contest to misdemeanor motor vehicle homicide in September. However, Judge Timothy Phillips sentenced Clemans on Nov. 20 to two years of probation, a $500 fine and 240 hours of community service.

Clemans was charged after a March 30 crash at the intersection of Old Cheney Road and Nebraska Highway 2 that killed Monty McMahon, of Lincoln.

Police say a car driven by McMahon was struck by Clemans’ vehicle as Clemans tried to turn left. McMahon was pronounced dead at a Lincoln hospital.

WILBER, Neb. (AP) — A company has announced that it plans to create three wind farms in southeastern Nebraska.

Aksamit Resource Management’s projects represent a $725 million investment in Saline, Thayer and Fillmore counties.

The projects include a 300-megawatt site that will have 150 turbines spread out over 30,000 acres in Saline and Fillmore counties and a 76-megawatt project that will have 40 turbines on 8,000 acres in Thayer County. Those two projects are scheduled to be operational in 2019.

A 73-megawatt farm with 40 turbines is planned for Saline County, and is expected to be operational within the next two years.

Aksamit announced this week that it has filed with the Southwest Power Pool to hook up two of the wind farms to power transmission lines owned by the Nebraska Public Power District.

FRIEND, Neb. (AP) — One person died and several people were injured after a car and a sports utility vehicle collided in southeast Nebraska.

The crash happened Thursday in Saline County west of Friend.

Saline County Sheriff Alan Moore says a 2004 Pontiac Bonneville was pulling onto U.S. Highway 6 off a county road when it was hit by an eastbound 2003 Dodge Durango.

The Bonneville had two passengers, and the driver was the only one in the Durango. One of the Bonneville passengers was flown to a Lincoln hospital and later died.

The crash remains under investigation.

PENDER, Neb. (AP) — The U.S. Supreme Court has scheduled oral arguments for a case that will determine whether businesses that sell alcohol in the village of Pender can be regulated by the Omaha Tribe of Nebraska.

Oral arguments will take place on Jan. 20 in Washington. At issue is whether the Nebraska village is a part of the Omaha Indian Reservation.

The Omaha Tribe passed an alcohol ordinance in 2006 requiring businesses that sell alcohol on the reservation to buy liquor licenses. The ordinance also placed a 10 percent sales tax on all alcohol purchases.

Owners of seven Pender establishments sued the tribe in U.S. District Court in Omaha, saying they were not subject to the ordinance because Pender is not on the reservation.

LINCOLN, Neb. (AP) — The Nebraska Supreme Court has upheld a former prison worker’s conviction and 1- to 2-year sentence for having sex with an inmate at the women’s prison in York.

Michael Weichman, who had been a staff maintenance employee, was convicted in March. State law says any prison or jail worker who has sex with an inmate has committed sexual assault.

In his appeal, Weichman argued that statements he made during a polygraph test admitting to the sexual relationship should not have been allowed. He also argued that the inmate’s statements acknowledging the sex should have been thrown out.

On Friday, the high court rejected Weichman’s arguments, saying he was aware he did not have to take the polygraph test and that he had been informed of his right to remain silent.

OMAHA, Neb. (AP) — An Omaha park is one step closer to honoring a police officer who was killed in the line of duty in May.

The Omaha Parks Foundation received nearly $18,500 Thursday to renovate a Miller Park baseball field in honor of Kerrie Orozco.

The money was raised through the sale of Kansas City Chiefs flags that read “This is Chiefs Kingdom.” The flags were sold in Omaha and Council Bluffs Hy-Vee Supermarkets and City of Omaha community centers on Sept. 17.

The Miller Park renovations will include a new infield, irrigation for the outfield, field lights, bleachers and fencing. It will be named the Kerrie Orozco Memorial Ballfield.

Orozco lived in Council Bluffs, Iowa, with her family and was a native of nearby Walnut, Iowa.

OMAHA, Neb. (AP) — A judge has set bond at $1 million for a former Omaha gang leader-turned community activist arrested earlier this week on a gun charge.

Police say Terry Barfield met with an undercover federal agent on Tuesday to buy a handgun. It’s illegal for convicted felons to have a gun.

Barfield was released from prison in June after serving more than 10 years for the 2003 shooting death of a man outside a south Omaha housing development.

Upon his release, Barfield worked with an Omaha city councilman to speak out against gang violence.

Barfield’s attorney, Glenn Shapiro of Omaha, says he has not yet asked Barfield for his version of what happened Tuesday. Shapiro says he wants to first see what evidence prosecutors have at a Dec. 16 preliminary hearing.

HASTINGS, Neb. (AP) — A former Hastings High School teacher has accepted a plea deal after he was accused of having sex with a 15-year-old female student.

39-year-old Johnathan Shafer pleaded no contest to contributing to the delinquency of a minor and negligent child abuse. Both charges are misdemeanors punishable by up to one year in jail and a $1,000 fine.

In exchange, prosecutors dropped a first-degree sexual assault of a child charge that could have carried a 15-year sentence.

Adams County Attorney Donna Fegler Daiss says the deal was made after the girl told police she had been mistaken on the relationship’s time frame and that she was 16 when it began.

Nebraska prohibits people 19 and older from having sexual contact with people younger than 16.
