LINCOLN, Neb. (AP) — Authorities say two Lincoln brothers have been arrested in the sexual assault of a 10-year-old girl.

The suspects, ages 22 and 32, were arrested Sunday morning.

According to Lincoln Police Investigator Troy Cockle, authorities believe the 22-year-old suspect has sexually assaulted the victim at least three times. He faces two counts of first-degree sexual assault of a child and one count of third-degree sexual assault of a child.

Cockle said police believe the 32-year-old brother has assaulted the girl on a weekly basis. The suspect faces one count of first-degree sexual assault of a child.

Both men are set to appear in court Tuesday.

OMAHA, Neb. (AP) — A 25-year-old man awaiting trial in two 2014 slayings has been charged again with fatally shooting one man and wounding another at a northeast Omaha store in 2009.

Police say Akeem Jones is charged with murder, assault and two weapons counts stemming from the March 11, 2009, shooting inside BJ’s convenience store. Twenty-two-year-old Gary Holmes died later and Rodney Smith, then 22, was hospitalized.

Jones was charged with the same crimes then, but a judge dismissed the case a year later when a key witness didn’t show up for a hearing.

Jones also is accused of killing Johnnesha Brown and her boyfriend, Stephen Arps, in November 2014. Jones has pleaded not guilty.

His attorney in the 2014 case didn’t immediately return a call Tuesday from The Associated Press.

GRAND ISLAND, Neb. (AP) — A man has been hospitalized after a fire that damaged an apartment in Grand Island.

The fire was reported around 11 p.m. Sunday at the Holiday Garden Townhouses. Grand Island Fire Chief Cory Schmidt says firefighters found the man near the doorway to the apartment, and he was taken to a hospital. The carcass of a dog was found inside the apartment.

Schmidt says the fire was contained to the apartment kitchen, but smoke reached other apartments as well, temporarily displacing the tenants.

The fire cause is being investigated.

PLATTSMOUTH, Neb. (AP) — A December trial has been scheduled for a 35-year-old eastern Nebraska man accused of shackling his teenage nephew to a bed to keep the boy from going out and misbehaving.

Cass County District Court records say Wade Merry, of Plattsmouth, on Monday pleaded not guilty to felony child abuse. His trial is set to begin on Dec. 2.

Police say the 14-year-old was shackled to the bed at least a dozen times. A court document says Merry told police he restrained the boy while Merry worked overnight shifts at a bakery. Merry says he was frustrated by the boy’s behavior problems.

Police say Merry gave the boy a cup in case he needed to use a bathroom while shackled.

LINCOLN, Neb. (AP) — A newly-appointed Nebraska Supreme Court justice has been subpoenaed by an attorney seeking to have felony charges against his client dismissed, arguing that the judge’s delay in ruling on a motion in the case violated his rights.

Defense attorney Matt Catlett tells said he subpoenaed former Lancaster County District Judge Stephanie Stacy to find out why it took her eight months to rule on a motion to suppress evidence in the drug possession case against 48-year-old Scott Johnson. Catlett contends Stacy simply forgot about the motion, violating law that requires defendants be brought to trial within six months of charges being filed.

Stacy was appointed to the Nebraska Supreme Court last month by Republican Gov. Pete Ricketts. She began her new appointment Thursday.

LINCOLN, Neb. (AP) — University of Nebraska-Lincoln students have transformed several downtown parking spaces into temporary urban parks.

On Monday, a team of students set up a dozen exhibits as part of (Park)ing Day, a global challenge to transform parking stalls into interactive public parks for a day. The students spent the past few weeks finding materials and creating seating with pallets, cloth and other materials.

Students also used cardboard to make a two-hole mini golf course and 5,000 plastic bottles to assemble a small maze.

Assistant professor Peter Olshavsky introduced the project four years ago at the University of Nebraska-Lincoln to teach architecture students about the design process from concept to final construction.

LINCOLN, Neb. (AP) — Lincoln police say a man who was shot outside the Nebraska Capitol was fleeing from authorities who had initiated a traffic stop.

Capt. Dan Reitan says police stopped the man shortly after 1 p.m. Tuesday about four blocks west of the Capitol before he fled.

Reitan says officers were told the man was armed. He says the man was shot at least once on 14th Street along the western edge of the Capitol. No officers were injured.

Nebraska state Ombudsman Marshall Lux says he saw the man being chased by a police officer across the lawn. The man then turned and ran into a street bordering the building.

Lux says he heard three shots but didn’t see the shooting.

DENVER (AP) — A doctor says a Colorado man accused of killing his wife after eating marijuana-infused candy bought at a legal pot shop was experiencing psychotic-like symptoms due to the drug.

The doctor’s findings are contained in recently filed court documents in the case of 49-year-old Richard Kirk, who is charged with first-degree murder in the April 2014 shooting death of his wife, Kristine. Police say he ate the candy, then shot her while she described his erratic behavior on a 911 call.

He pleaded not guilty by reason of insanity on Friday.

The doctor, Andrew Monte is a defense witness. He says Kirk was intoxicated with THC, the drug’s psychoactive ingredient, which led to delirium.

Prosecutors say Kirk and his wife had been fighting over marital and financial problems.

ALBION, Neb. (AP) — The body of a 79-year-old man has been recovered from a grain bin of corn northwest of the Boone County town of Albion.

Boone County Sheriff Denny Johnson says his office was notified about the situation Thursday afternoon after a neighbor noticed that corn being taken from the bin was spilling out of a grain truck and that the truck driver didn’t seem to be around.

Johnson says Edwin Karel, of Albion, apparently became trapped after entering the bin to loosen corn that wasn’t feeding into the auger.
