LINCOLN, Neb. (AP) — A judge has dismissed a lawsuit that a Nebraska mother hoped would restore her position as a private-duty nurse for her son who is disabled and autistic.

Dee Shaffer filed appeals with a state agency and sued in district court after the state reneged on a contract allowing her to be paid to take care of her son.

The state’s managed care provider, Coventry, had determined that the services weren’t medically necessary.

Shaffer was successful in her lawsuit challenging the state agency on medical necessity ruling, but Coventry appealed. The Supreme Court reversed and vacated the district court order since Coventry wasn’t included as a necessary party.

A Lancaster County judge has determined that because of the former court ruling, he couldn’t find that the care was medically necessary.

LINCOLN, Neb. (AP) — The 32-year-old son of a Lincoln councilman and a federal judge is scheduled to be sentenced in October for violating a protection order granted to a woman he’s accused of sexual assaulting.

Jonathan Camp was convicted Tuesday. He faces up to a year in jail when he’s sentenced on Oct. 16. Authorities say that he’d sent two text messages to the woman in March.

Camp has pleaded not guilty in the original case to a charge of sexually assaulting an incompetent person. A court document says the woman reported that he’d drugged her at a home on the night of Sept. 8 and then sexually assaulted her.

His parents are Councilman Jon Camp and U.S. District Judge Laurie Smith Camp.

LINCOLN, Neb. (AP) — A 54-year-old man has been sentenced to prison for the crash death of a Crete resident last year.

Online Lancaster County District Court records say Diep Dong was sentenced Wednesday. He’d pleaded guilty to vehicular homicide and willful reckless driving after prosecutors lowered the homicide charge from manslaughter. Dong was given three to five years for vehicular homicide and three months for reckless driving, to be served at the same.

Authorities say Dong’s vehicle rammed into an oncoming vehicle when Dong tried to pass in a no-passing zone near Crete on Sept. 18. The dead man was identified as 28-year-old Abraham Raymundo, who lived in Crete.

 

LINCOLN, Neb. (AP) — A 33-year-old Lincoln man has been sentenced to seven years and four months in federal prison for conspiracy to distribute methamphetamine.

Matthew John Horn was sentenced Wednesday. According to a news release from U.S. Attorney Deborah R. Gilg, Horn was responsible for distributing at least 18 ounces of methamphetamine between April 2013 and May 2014.

Horn will serve four years on supervised release following his prison term.

HASTINGS, Neb. (AP) — Hastings leaders have vowed to help find workers to staff a proposed behavioral health treatment center for prison inmates, if it were placed in the south-central Nebraska city.

The local leaders made their pitch at a legislative hearing held Wednesday in the Hastings City Council chambers.

Dave Rippe, executive director of the Hastings Economic Development Corporation, told the lawmakers that “staffing hurdles are not exclusive to Hastings, and should our state elect to go forward with this facility, these hurdles will need to be addressed regardless of location.”

The Legislature passed a bill in spring 2014 authorizing $199,000 to study placement of the center at the Hastings Regional Center, a former state psychiatric hospital.

OMAHA, Neb. (AP) — A 31-year-old Omaha man has been sentenced to up to 70 years for the shooting death of his estranged friend.

Kenneth Armour Jr. was sentenced Wednesday in Douglas County District Court to 50 to 60 years for second-degree murder in the Nov. 5 shooting death of 30-year-old Michael Stubbs. Armour also got 10 years for a weapons count in the case.

Investigators testified an argument that began on Facebook between the two men led to the fatal shooting in northwest Omaha. Stubbs identified Armour as the shooter before he died. Police said the two men had been friends, but had a falling out over a woman.

Armour had originally been charged with first-degree murder, but pleaded guilty earlier this year to second-degree murder in a deal with prosecutors.

OMAHA, Neb. (AP) — The owner an old Omaha mansion plans to proceed with demolition efforts despite an offer from a buyer wanting to restore it.

The three-story mansion, built in the early 1900s, has been condemned since a January fire that investigators say was caused by a space heater in the attic used to prevent pipes from freezing.

John Metz, who shares the last name of the mansion’s original occupant but isn’t a direct relative, says he offered a price “in the $200,000 range” for the property. County records show it’s more than the $170,000 that current owner Mansion Flats LLC paid for the mansion.

A Mansion Flats representative said Tuesday that Metz’s proposal fell short of the group’s “current investment.”

NELIGH, Neb. (AP) — A Nebraska music instructor has paid for 100 signs that say, “We Support Neligh (NEE’-lee),” in an effort to promote the town in a more positive light and unite residents.

Nate Metschke, who teaches at the Neligh-Oakdale school district, says his campaign began before the annexation of several properties along Highway 275 finished.

The Neligh City Council voted last month to approve a third and final reading of annexation ordinances. An effort to recall the mayor and the entire council began in June after a second reading of the measures.

Metschke says his goal was to help residents feel positive about their community, after he was questioned by people from other towns about the situation in Neligh.

He says he has received great feedback from others about the signs.

ALLENSPARK, Colo. (AP) — Three teenage boys who were reported missing after they failed to return from a fishing trip in Allenspark have been found safe.

Authorities say that the boys, ages 15 to 17, were staying in a cabin with a leadership group when they went fishing Tuesday evening. The boys apparently hiked down some steep terrain and couldn’t get back up in the dark.

The Boulder County Sheriff’s Office says that the boys were well prepared to spend the night outdoors and made a fire until morning.

Rescuers reached the boys Wednesday morning. Authorities launched the search due to the boys’ unfamiliarity with the area and temperatures that dipped into the 40s.

The boys were not named because of their ages. They came from Padroni, Colorado; Sidney, Nebraska; and Peetz, Colorado.

LINCOLN, Neb. (AP) — Prosecutors have dropped charges filed against a Lincoln man accused of accelerating his car to strike and injure a woman.

Bradley Lilleston had been charged with domestic assault and use of a weapon.

Chief Deputy Lancaster County Attorney Pat Condon told the newspaper that the woman didn’t cooperate with prosecutors and didn’t show up at an Aug. 4 hearing for Lilleston.

Court documents say Lilleston threw some photos in front of the car on May 21 and that he accelerated when the woman tried to retrieve them. The documents say she was thrown over the hood and windshield and suffered a cut on her forehead and swelling on her right shin.
