After 17 Years, Florida, Nebraska Company Lawsuit Continues

ne-supreme-courtOMAHA, Neb. (AP) — Seventeen years after it started, a multimillion-dollar insurance dispute between the state of Florida and a Nebraska company continues to meander through the courts.

The Nebraska Supreme Court has ruled on aspects of the case four times, and the primary defendant, David Fulkerson, died in 2009. But none of that has ended the lawsuit that began in 1998.

Chris Welsh, president of the Nebraska Association of Trial Attorneys, says it’s unusual for a case to drag on this long.

The National Center for State Courts says Nebraska courts strive to have jury judgment in civil lawsuits within 18 months of when they are filed.

?The case centers on the relationship between Fulkerson’s former company, Countrywide Insurance Agency, and an insolvent insurance company that Florida regulators took control of in 1997.

2 Killed, 6 Wounded in Omaha Attack

crimeOMAHA, Neb. (AP) — Authorities say two women were shot and killed and six other people were wounded in an early-morning attack at a home in Nebraska’s largest city, Omaha.

Police say officers responded to a report of gunfire at a home at the intersection of North 34th and Parker streets shortly before 2 a.m. on Saturday.

The department said in a news release that two women in their 20s were dead at the scene and that three people were taken by ambulance to University of Nebraska Medical Center. One is in critical condition and the other two are in serious condition.

Three other wounded people were driven in a private vehicle to the hospital.

The department hasn’t identified the victims or any suspects in the shooting.

UNL Reassigns Assistant Professor Accused of Sexual Assault

LINCOLN, Neb. (AP) — The University of Nebraska-Lincoln has reassigned an assistant professor accused of sexually assaulting a 12-year-old boy.

University spokesman Steve Smith said 33-year-old Jeff A. Hawks has been reassigned to faculty duties that don’t involve working with students. He had been a research assistant professor of mechanical and materials engineering since 2011.

Hawks, a Lincoln youth baseball coach, was charged Tuesday with third-degree sexual assault of a child. Reports say the sexual abuse occurred during stretching exercises at a training session sometime between August and December.

Hawks has also been removed from his role in the Lincoln Sox youth baseball organization.

Hawks was released from jail Wednesday and has been ordered to avoid unsupervised contact with any unrelated child younger than 16.

Family of Boy Who Drowned at Omaha School Seeks $1 Million

lawsuit-settlementOMAHA, Neb. (AP) — The family of a 12-year-old boy who drowned at an Omaha school last fall is seeking $1 million from the district.

James Martin Davis submitted a claim to Omaha Public Schools this week on behalf of Demariont’e Brown-Elliott, who died on Nov. 13 at Nathan Hale Middle School. Ten students were being supervised by one teacher during a gym aquatics class when Brown-Elliott was pulled from the pool.

In the claim, Brown-Elliott’s family alleges his death was the “direct and proximate result” of the district’s negligence.

The district has six months to respond. If the deadline passes or the claim is denied, the family can file a lawsuit.

Davis says the family is hoping that sending the claim will prevent future drownings.

Sioux City Brothers Sentenced to Prison for Robberies

SIOUX CITY, Iowa (AP) — Two Sioux City brothers have been sentenced to federal prison for the armed robbery of two drug dealers.

Officials say 23-year-old Jamal Dean was sentenced Thursday to life in prison after being found guilty of several convictions, including carjacking and two counts of robbery, among other convictions. His 25-year-old brother, Levon Dean Jr., was sentenced to more than 30 years.

According to a release, Jamal Dean was already serving a 25-year prison sentence after pleading guilty to attempted murder in the April 2013 shooting of a Sioux City police officer.

The release says the two traveled together from Nebraska to Iowa and conspired to rob local drug dealers on two occasions in April 2013. After each attack, the brothers returned to Nebraska.

Ex-Nebraska Teacher Gets Jail, Probation in Teen Booze Case

PAPILLION, Neb. (AP) — A former suburban Omaha teacher and her husband who were accused of serving alcohol to minors have been sent to jail and given probation.

Online court records say 50-year-old Ann Urwiler and 48-year-old Jon Urwiler on Thursday were each sentenced to 39 days in jail and two years of probation and fined $1,000 each. They’d pleaded guilty to contributing to the delinquency of a child. Sarpy County prosecutors dropped charges of procuring alcohol for a minor in exchange for their pleas.

Police say officers saw teenagers fleeing from a party at the Urwilers’ Papillion home in July.

A school district spokeswoman says Ann Urwiler in September quit her job as a first-grade teacher at Papillion’s Trumble Park Elementary School.

2 Men Plead Not Guilty in Fatal Lincoln Stabbing

stabbingLINCOLN, Neb. (AP) — Two men have pleaded not guilty to first-degree murder charges and attempted robbery.

23-year-old Derick Lewis entered a written not-guilty plea Wednesday. Nineteen-year-old Joshua Nootenboom-Carr submitted his plea last month.

Police say the two are believed to have shot to death 21-year-old Maurice Williams in August when they went to his home to rob him. Police say the men entered Williams’ apartment with a rifle and shot Williams in the chest.

Nootenboom-Carr also faces two counts of using a firearm to commit a felony and possession of a stolen firearm.

Attorneys for the men could not be located. Their trial dates have not yet been set.

Sheriff Suspends Douglas County Crime Lab Director

douglas-county-sheriffOMAHA, Neb. (AP) — The Douglas County crime lab director has been suspended and an investigation has been ordered for several cases handled by the lab.

Sheriff Tim Dunning put Tracey Ray on paid leave in October, and then on Jan. 6 suspended her without pay for 30 days. She’s appealing her suspension to the Douglas County Civil Service Commission.

A letter from Douglas County Chief Deputy Sheriff Tom Wheeler to Ray’s attorneys says a status review of cases she was working on “brought to light several potential issues involving the improper handling of evidence, to include packaging, labeling, storage and security.”

Ray was hired in 2010 after former crime lab chief David Kofoed’s (KOH’-fohd’s) conviction for planting evidence in a Cass County double murder.

Lincoln Man Pleads Not Guilty to Charge He Killed His Wife

LINCOLN, Neb. (AP) — A Lincoln man whose wife’s body was found in a self-storage unit has pleaded not guilty to a charge that he killed her.

Thirty-three-year-old Kevin Miller entered the plea on Wednesday. He’s charged with first-degree murder and other crimes in the slaying of 28-year-old Kelsey Miller. Her body was found Dec. 7 in the Lincoln storage unit.

Authorities say she was beaten and shot in the head.

Lincoln Youth Baseball Coach Accused of Child Sex Abuse

LINCOLN, Neb. (AP) — Police have arrested a Lincoln youth baseball coach following accusations he sexually abused a 12-year-old boy during private training lessons.

Prosecutors charged 33-year-old Jeff A. Hawks on Tuesday with third-degree sexual assault of a child.

Investigators say the child told them Hawks inappropriately touched him outside his clothing while they were alone during their sessions between August and December. Hawks’ attorney declined to comment to the Lincoln Journal Star.

Hawks recently served as board president of Lincoln Sox Baseball and has been involved with the organization for about three years.

The group’s vice president says it’s investigating the matter. He says Hawks is no longer involved with the organization.
