Iowa Man Requests New Trial in Fatal Shooting

DAKOTA CITY, Neb. (AP) — A 23-year-old Iowa man convicted of killing a northeast Nebraska woman has requested a new trial.

The attorney for Raymond Gonzales Jr. filed the motion on Wednesday. The attorney says problems with the trial include jury misconduct and a verdict not supported by sufficient evidence.

A jury on Dec. 9 found Gonzalez guilty of first-degree murder and use of a firearm to commit a felony. Authorities say he shot 28-year-old Bonnie Baker 16 times in December 2013 at a party in her South Sioux City home.

Witnesses say Gonzales became upset after people at the party teased him.

A district judge has ordered a hearing on the motion for Feb. 5, the same day Gonzales is scheduled to be sentenced.

Nebraska Couple Sent to Prison for Tax Evasion

judgeshipLINCOLN, Neb. (AP) — The former owners of a southeast Nebraska gun shop are going to prison for sales and income tax evasion.

Robert Androyna and Hope Androyna were sentenced Thursday in Lancaster County District Court. Robert Androyna was given two consecutive 18- to 36-month prison terms. His ex-wife was given two one-year terms to be served at the same time.

The two pleaded no contest in October to failing to pay sales and income tax.

State officials say their gun business took in $3.78 million from 2009 through 2012, but they did not report any income or send in nearly $200,000 collected in local and state sales taxes.

Officials had said the Androynas owed more than $479,000, but agreed to pay $187,000 in restitution.

Columbus Man Pleads Guilty to Exposing Himself to Teens

columbus-policeCOLUMBUS, Neb. (AP) — An eastern Nebraska man has pleaded guilty to exposing himself to two 17-year-old girls at a city library.

22-year-old Mitchell Ryan admitted to two counts of public indecency on Thursday. Prosecutors dropped a charge of obstructing a police officer in the plea deal.

Police were called to the library on Oct. 27 by the high school students. The arresting officer says Ryan pulled away from him and fled on foot during the arrest. He was later found hiding in a dumpster.

Ryan faces up to a year in jail when he is sentenced in January. He was previously convicted of indecent exposure in September 2013.

Iowa Senate Candidate Faces Charges in Nebraska

GLENWOOD, Iowa (AP) — A Libertarian candidate running for the Iowa Senate seat vacated by U.S. Senator-elect Joni Ernst faces a misdemeanor sexual assault charge in eastern Nebraska.

69-year-old Donald Brantz has also been charged with assault, disturbing the peace and interfering with a public service company in Sarpy County.

Prosecutors say Brantz is accused of inappropriately touching a woman on Oct. 10 and threatening to choke her. Authorities say he hung up a phone the woman used to call 911.

Brantz has pleaded not guilty. His attorney, Chad Primmer of Council Bluffs, did not immediately return a message Friday.

Brantz is a former Mills County Board member. He faces Republican Mark Costello, of Imogene, and Democrat Steven Adams, of Red Oak, in the Dec. 30 election.

Nebraska Man Sentenced to Prison for 2011 Shooting Death

jailPIERCE, Neb. (AP) — A Columbus man has been sentenced to 10 to 14 years in prison for the shooting death of a Norfolk teenager in 2011.

24-year-old Daniel Hofmann was sentenced Thursday in Pierce County District Court. He had pleaded guilty to manslaughter in October, when he admitted to shooting his friend, 18-year-old Wesley Kuester, in April 2011. Three other charges were dropped as part of the deal.

Authorities say Hofmann shot Kuester with a shotgun while they were playing with guns after drinking.

Hofmann had faced up to 25 years in prison.

Fremont Man Charged in Sept. 11 Crash Death

fatal-accidentOMAHA, Neb. (AP) — The Douglas County prosecutor has charged a Fremont man with misdemeanor motor vehicle homicide for a September crash that killed another man.

A news release from Douglas County Attorney Don Kleine says 21-year-old Gregory Swatzell was driving a trailer truck in on state Highway 36 on Sept. 11 when he ran a stop sign and hit a sport utility vehicle, killing its driver, 36-year-old Ryan Boelman of Bennington.

The misdemeanor charge carries a penalty of up to a year in jail and a $1,000 fine.

Swatzell’s arraignment date has not yet been set.

2 Lincoln Nonprofits to Open Health Clinic

Medical-ChartLINCOLN, Neb. (AP) — Two Lincoln nonprofit health providers are planning to combine their operations to form a medical clinic that’s expected to open next December.

The Health 360 Clinic, which will provide primary health care and behavioral health services, will be inside a former office supply store in Lincoln.

Lutheran Family Services of Nebraska and the People’s Health Center say they chose that site because of its proximity to public transit, downtown area and schools.

The nonprofits are planning to open a smaller clinic in the Lutheran Family Services’ offices. That clinic will begin offering its services in January and will continue to operate until the larger clinic opens in 2015.

Omaha Board Prepping for Potential Charter School Bills

omaha-psOMAHA, Neb. (AP) — The Omaha Public Schools board is considering a resolution to show support for the concept of charter schools operated under strict guidelines.

Nebraska is one of eight states that don’t allow charter schools, which are independent, taxpayer-funded schools usually operated by private groups. Several bills to OK them have failed in the Legislature, including one last year that would have established five charter schools in Omaha.

Newly elected Gov. Pete Ricketts supports the idea of charter schools. With another charter school bill likely, several OPS board members said they needed to be proactive in helping steer what a school choice system in Nebraska could look like.

Board member Marian Fey said the resolution was a way for the board to have a discussion about charter schools.

Lincoln Woman Gets Probation for Embezzlement from Family Business

ne-supreme-court-gavelLINCOLN, Neb. (AP) — A Lincoln woman has been given probation for stealing money from employees at her family restoration business.

A federal judge sentenced Karen L. Gagner on Tuesday to five years’ probation on charges of embezzlement and theft. She was ordered to pay more than $36,000 in restitution.

Gagner was accused of transferring nearly $100,000 from employee 401(k) accounts between 2008 and 2011. She later admitted to using the money to help sustain Gagner Restoration.

The restitution will be paid to two employees.

Nebraska Man Sentenced in Gun Possession Case

gavel-moreOMAHA, Neb. (AP) — An Omaha man has been sentenced up to 18 months in prison on a firearm charge after taking a deal with prosecutors.

A Douglas County district judge rendered the punishment to 20-year-old Malik Watson on Wednesday. Watson pleaded guilty to possessing a firearm and false impersonation.

He was originally charged in the March 30 shooting of 18-year-old Bobby Jones but those charges were dropped in the deal. Omaha police say Jones was shot in the right forearm and that Watson gave officers false information about his identity.

Jones survived the shooting.
