2nd District House Race Down to 13,600 Ballots

OMAHA, Neb. (AP) — Around 13,600 ballots remain to be processed and counted in two counties to determine who will represent Nebraska’s 2nd Congressional District for the next two years in Washington.

By Wednesday morning, Democrat Brad Ashford had nearly 49 percent of the vote to incumbent GOP Rep. Lee Terry’s 46 percent. Libertarian Steve Laird had about 5 percent.

Terry’s campaign says he’ll be making an announcement at a news conference on Wednesday afternoon. A spokeswoman declined to say whether Terry intended to concede the election.

Douglas County election commissioner Dave Phipps says about 13,000 ballots from early voters remain to be processed and that the counting will begin Friday morning. Sarpy County election commissioner Wayne Bena (BEH’-nuh) says nearly 570 provisional ballots remain to be processed and then counted this week.

Nebraskan Charged with Abuse in Death of Baby Son

child-abuseATKINSON, Neb. (AP) — A 26-year-old northern Nebraska man has been charged with intentional child abuse following the death of his son at an Omaha hospital.

Michael Schroeder, of Atkinson, was arrested on Saturday. He’s accused of abusing his 8-month-old son, Kalium Ebsens. Online records say Schroeder remained in Holt County Jail on Wednesday. Online court records don’t list the name of his attorney.

A court affidavit filed by an Atkinson officer says the boy was taken to West Holt Memorial Hospital the night of Oct. 26 after he’d become unresponsive. The infant then was flown to an Omaha hospital, where he died the morning of Oct. 29. The officer said Schroeder acknowledged bumping the boy’s head a couple of times.

Hall County Board OKs Clerk to Appoint Daughter-in-Law

hall-countyGRAND ISLAND, Neb. (AP) — The Hall County clerk has been given the greenlight to promote her daughter-in-law to deputy county clerk.

On Tuesday, county clerk Marla Conley asked the Hall County Board of Supervisors for permission to appoint her daughter-in-law, Shanda Conley, to the position. The county’s nepotism policy requires such notification.

Shanda Conley has worked in the clerk’s office since 1999.

The position became available because longtime deputy clerk Pam Dubbs is taking a job at Hall County Jail. It left Shanda Conley as the only employee in the county clerk’s office to appoint.

The board voted 4-3 to allow Conley to be selected as deputy. But Marla Conley says that even though she has the board’s consent to appoint her daughter-in-law, she still needs time to think through her decision.

LYONS, Neb. (AP) — Authorities say a piece of human skull found two years ago in northeast Nebraska is not from the body of a woman missing since 1995.

Burt County Attorney Dan Smith said DNA analysis showed the fragment didn’t belong to the body of 48-year-old Wanda Krumwiede. Krumwiede, of Lyons, disappeared shortly after filing for divorce to end her 25-year marriage to Wilhelm Krumwiede.

Wilhelm Krumwiede was charged with her murder but was twice acquitted. He died in 2003 at the age of 66.

Authorities say the fragment was uncovered in early November 2012 by a contractor digging on land near Lyons.

The incident occurred shortly after 8 p.m. Saturday in Beatrice. The boy told officers he’d seen his mom’s boyfriend punch her several times. The boy and four others his age or younger were in the home at the time.

Officers arrested 31-year-old Steven Kling, of Marysville, Kansas. He told them he did not strike the woman.

Kling’s bail was set at $10,000 on Monday in Gage County Court. His next hearing is scheduled for Nov. 17. Online court records don’t list the name of his attorney.

Nebraska Man Gets Prison for Shooting Eagle, Hawk

bald-eagle-shotLINCOLN, Neb. (AP) — A Nebraska man convicted of shooting a bald eagle and a rough-legged hawk earlier this year has been given eight months in prison.

U.S. Attorney Deborah R. Gilg said Monday that 45-year-old Lamar Bertucci’s sentence will be followed by one year of supervised release. He was also ordered to pay $6,500 in restitution.

Bertucci pleaded guilty this year to violating the Bald and Golden Eagle Act and the Migratory Bird Treaty Act. He is accused of shooting the bald eagle in February. An investigation into his activities yielded the rough-legged hawk.

Bertucci had objected to the method used for valuing the birds. A report placed a $10,000 value on the bald eagle and $1,750 on the hawk. In the end, a judge determined $6,500 in restitution.

Police say 36-year-old Kimberly Ann Pankratius was waiting for a parking spot outside a Wal-Mart Saturday night when she allegedly yelled at a couple for taking the space.

Pankratius is accused of driving her car toward the couple and hitting the woman in the arm with a side mirror. The woman later refused treatment.

Police say Pankratius drove away but the couple took down her license plate information. She was arrested a short time later.

Pankratius faces charges of second-degree assault and using a deadly weapon to commit a felony. Court records do not list an attorney.

Anthony Garcia

OMAHA, Neb. (AP) — The former doctor accused of killing four people with ties to an Omaha medical school is challenging his arrest and some of the initial searches police conducted.

Attorneys for Anthony Garcia, or Terre Haute, Indiana, argued Monday the arrest was improper because the warrant wasn’t issued until several hours afterward.

Prosecutors defended the warrants, and they maintain all the affidavits filed in court were valid.

Garcia is charged with first-degree murder in the 2008 deaths of the 11-year-old son of Creighton University pathologist William Hunter and the family’s housekeeper, as well as the May 2013 deaths of Creighton pathologist Roger Brumback and his wife.

Authorities say Garcia was motivated by revenge for being fired from Creighton’s pathology department in 2001. He has pleaded not guilty.
