Omaha Police Seek to Have Brutality Suit Dismissed

omaha-police(AP) — Several Omaha police officers being sued by a man who accuses them of using excessive force in a 2011 arrest have filed a motion to dismiss the lawsuit, claiming they are immune from such suits.

The videotaped arrest of Robert Wagner, of Omaha, outside a hospital emergency room led to accusations of police brutality.

A hospital security camera captured images of several Omaha police officers pinning down Wagner in the parking lot. The video seemed to show one officer kicking him while he was restrained on the ground. Two officers were fired, but both were later reinstated following arbitration.

Wagner filed a federal lawsuit last November against the city and several officers, saying the officers used excessive force and conspired to deprive him of is constitutional rights.

Fremont Sets Special Election on Rental Ban

fremont-ne(AP) — The Fremont City Council has scheduled a special election so residents can decide on whether to remove the city’s ban on renting housing to people who aren’t in the U.S. legally.

The council voted 7-1 on Tuesday night to hold the special election on Feb. 11.

A city ordinance bans hiring or renting to people who can’t prove they are legally in the country. The housing portion of the law has been put on hold pending legal challenges. A federal appeals court backed the ordinance in June, but ordinance opponents could appeal.

The council has been considering repealing the housing portion of the ordinance, but on Tuesday night members opted to leave the decision to voters. The ordinance received 57 percent approval in a 2010 election.

Neb. Mom Gets Prison for Negligent Child Abuse

(AP) — A 23-year-old southeast Nebraska woman has been given two to four years in prison for leaving her infant son in the care of a parolee who’d served time for child abuse.

Online court records say Kayla Jurgensen, of Crete, had pleaded no contest to negligent child abuse and being an accessory to a felony: the beating of her young son.

Her ex-boyfriend, 26-year-old Matthew Wylie, last month was given 30 to 40 years in prison for assault. He’d pleaded no contest after prosecutors dropped a child abuse charge.

Wylie was arrested in December after Jurgensen took the boy to a hospital for treatment of a skull fracture. Jurgensen told officers that Wylie told her the boy fell off a bathroom counter.

7 Nominees’ Names Forwarded for Omaha Judgeship

judgeship(AP) — A judicial nominating commission has forwarded the names of seven nominees to Gov. Dave Heineman to consider as he fills an Omaha judgeship vacancy.

The nominees for Douglas County Court judge are C. Jan Headley, Jessica Kerkhofs, Dennis Lee, Ann Mangiameli, Michael Nelson, Steven Twohig, and Derek Vaughn, all of Omaha.

The 4th Judicial District consists of Omaha in Douglas County.

The vacancy is due to the retirement of Judge Edna Atkins.

Man Held in Beating Deaths of 2 Lincoln Men

(AP) — A 19-year-old Lincoln man has been accused of helping beat to death two people in Lincoln this past summer.

Court records say Richard McLaughlin III faces two weapons and two accessory charges. He’s being held in Lancaster County Jail. Online court records don’t list the name of his attorney.

Lincoln Police Chief Jim Peschong (peh-SHAWNG’) said Wednesday that McLaughlin is suspected of having ties to a gang called True Blue Soldiers that targeted the two victims. The two were identified as 20-year-old Nathan “Shane” Walton and 27-year-old David Mueller.

Walton was found beaten near his home on June 29. He died July 2. Mueller was found that same morning on a street north of downtown Lincoln. He died on July 7.

No other arrests have been reported in the case.

Man Pulled from Burning Truck at Lincoln Hospital

Saint-Elizabeth-Regional-Medical(AP) — Authorities are praising two good Samaritans for pulling a man out of a burning truck outside a Lincoln hospital.

The Lincoln Fire and Rescue Department says the incident in front of St. Elizabeth Regional Medical Center began Wednesday afternoon when witnesses noticed smoke coming from a truck that had just pulled in.

A man and woman approached and saw fire on the passenger side. They managed to open the driver’s door and pull out the unconscious man. They moved him onto nearby grass and pulled off some clothing.

Lincoln Fire and Rescue Capt. Ron Trouba called the pair’s help “nothing short of heroic.”

Firefighters later put out the fire. The man was taken to the hospital’s burn unit. His condition has not been released.

1 Dead in Crash at West Omaha Intersection

fatal-crash(AP) — Police say a 29-year-old man has died of his injuries sustained when he ran a red light in west Omaha.

The crash happened Wednesday morning at the intersection of 168th and Blondo streets. Police say Zachery Shedd ran a red light and was hit by a van driven by a 65-year-old Fremont man. Both Shedd’s car and the van hit a third car stopped at the intersection.

Police say Shedd was taken to Creighton University Medical Center, where he was pronounced dead. Investigators say he was not wearing a seat belt.

Nebraska Nuke Plant to Be Discussed at Public Meeting

fort_cal(AP) — Regulators will offer the public another update on the effort to rehabilitate Fort Calhoun nuclear power plant next week.

The Nuclear Regulatory Commission will hold another meeting on about the idle plant next Thursday.

Fort Calhoun, which sits across from Iowa on the Missouri River about 20 miles north of Omaha, has been offline since April 2011.

Fort Calhoun initially shut down for routine maintenance, but significant flooding in 2011, a small fire and a series of safety violations forced it to remain closed.

The meeting will be held from 6-9 p.m. next Thursday at the Ramada Plaza Hotel near 72nd Street and Interstate 80 in Omaha.

Sterling Man Dies 2 Months After Highway Crash

fatal-accident(AP) — A 21-year-old man has died two months after a rollover crash on a southeast Nebraska highway.

Authorities say Trevor Dolbow, of Sterling, died Sunday in a Lincoln hospital.

Dolbow was injured Sept. 8 when his sport utility vehicle rolled after drifting off Nebraska Highway 41 in Gage County. Dolbow’s mother, Angela Dolbow-Heidtbrink, said her son had been taking a birthday cake he’d baked to his girlfriend in Beatrice.

Men Resume Shuttle for Nebraska City Bar Patrons

liquor-sales(AP) — Two men have resumed their free shuttle service for patrons of Nebraska City bars.

Travis Gillespie and Frank Trombino had begun the service in February but were ordered to halt in March. The Nebraska Public Service Commission said the tips and donations the men accepted for their Safe Ride Shuttle Service put their operation into a commercial category. That required higher insurance coverage and special permits.

The man have raised their insurance coverage to $1.5 million and registered as a for-hire service so they can charge passengers if they wish to do so someday. For the moment, they charge a penny a ride that they say they’re not collecting from the riders.

The service resumed this month, running overnight on Fridays and Saturdays, from 8 p.m. to 2:30 a.m.
