The Wireless Enhanced 911 Surcharge Drops For Subscribers

The Nebraska Public Service Commission entered an order reducing the Wireless Enhanced 911 surcharge by ten percent (10%) for the upcoming year. As a result, based upon an estimated 1.3 million wireless subscribers, a ten percent (10%) reduction in surcharge represents a savings of approximately $1.56 million to subscribers during the Commission’s two-year budget cycle.

The Commission is required to review, on an annual basis, the surcharge for the Enhanced Wireless 911 Fund (Fund), pursuant to Neb. Rev. Stat. § 86-458.  The surcharge may be up to $.70 per active telephone number or functional equivalent for all counties but Douglas County, which remains capped by law at $.50.     Public Safety Answering Points and the Wireless Enhanced 911 Advisory Board recommended no change in the surcharge.  However, Commission staff testified that that a 10% reduction in the surcharge would allow the Fund to maintain a sufficient funding balance for five years.  At the end of five years, the balance of the Fund may need to be addressed once more and adjustments made to arrest the five year decrease in the ending balance of the Fund.

Citing the current balance of the fund and projected balances over the next five years, the Commission found the funding needed for NextGen 911 remains speculative and is not sufficient to justify maintaining high reserves in the Fund.  Furthermore, the Commission must act to balance current funding needs with the interest of the wireless subscribers paying the surcharge.  Therefore, the Commission decided that the surcharge should be reduced from $.50 to $.45.

The Commission will continue to review the surcharge level on an annual basis as required by statute.

Woman Who Ruined A Party by Biting Someone’s Ear Off…Loses Appeal

A Lincoln woman who was given five to 12 years in prison for biting off part of a man’s ear has lost an appeal of her conviction and sentence.

The Lincoln Journal Star reports that the Nebraska Appeals Court on Tuesday rejected arguments by Anna Godfrey.

Lincoln police say Godfrey was at a party in April 2010, got into an argument with several people and attacked the man because he or someone else in his group said she was fat. Godfrey said she bit him after he tackled and choked her.

The 23-year-old Godfrey said in her appeal that there wasn’t enough evidence to justify the verdict against her, that the jury’s instructions were problematical and that her sentence was excessive.

The Appeals Court disagreed with each point.

Don’t Hesitate, Deadlines Are Right Around The Corner

Deadlines are fast approaching for Nebraska citizens who want to register to vote in the Nov. 6 general election, Secretary of State John Gale says.

Gale outlined deadlines regarding voter registration for the November election:

–Mail-in voter registrations must be postmarked by Oct. 19. Registrations close at motor vehicle offices and state agencies on Oct. 19.

–In-person voter registration at county election offices ends at 6 p.m. Oct. 26.

Gale reminded people to update their voter registration if they have moved within a county, since this will save them time when they go to the polls.

The secretary of state’s website (www.sos.ne.gov) provides detailed information regarding the registration process. The website includes a voter registration form, addresses and phone numbers for county election offices, and a look-up tool that allows voters to verify their registration status.

Gale added,

“Take the time now to register to vote so you don’t miss out in casting a ballot in the November election.”

People with voting questions can contact their county election office or the Secretary of State’s Office at (402) 471-2555.
