Therapist treating Holmes had worries before shooting happened

DENVER (AP) — A Denver television station is reporting that a psychiatrist who was treating the suspected Colorado movie theater gunman asked University of Colorado police for a background check on the man six weeks before the July 20 shootings.

Monday that Dr. Lynne Fenton called university police about a background check on James Eagan Holmes in early June. It cited unidentified sources it said were familiar with the investigation into the shootings. The station reports that Fenton didn’t ask that Holmes be taken to a hospital for evaluation and observation.

Separately, ABC News reports that Fenton told a campus police officer in early June that she had concerns about Holmes.

Fenton’s attorneys didn’t immediately comment on the reports. University police and a university spokeswoman say they can’t comment, citing a judge’s gag order.

Holmes was a graduate student at the university. He is charged with killing 12 people and injuring 58 at an Aurora theater.

Jim Carman presses for repeal of weapon ban

North Platte Neb.- North Platte City Councilman Jim Carman proposed the repeal the 1975 ordinance  at the City Council meeting August 7th. The room was packed full of citizens interested in the outcome of this topic.

By unanimous decision the issue has been tabled to be discussed in the August 21st meeting. Carman feels this law is hard to enforce as the state already has a law that addresses this issue.

Many out of town visitors and Carman himself carry an unloaded weapon on the back window of their truck, or in their vehicle.

Carman claimed that the ordinance was hard to enforce, and suggested re-wording the law. City Attorney Douglas Stack said that this is a matter best left to discussion and thinking. The Council then voted unanimously to place the city ordnance on the Augusts 21st agenda.

Olympic Update – Day Thirteen

It’s an all-American affair in the women’s beach volleyball final today in London. Misty May-Treanor and Kelly Walsh Jennings have ruled the sport for the last decade, winning Olympic gold in 2004 and 2008. In what may be their Olympic swan song, they’ll face the other American duo in the tournament, Jennifer Kessy and April Ross, who shocked a heavily favored Brazilian team in the semifinals. Also tonight in prime time, you’ll see the women’s 200 meter dash, where Americans Carmelita Jeter and Allyson Felix hope to get on the podium while 400 meter gold medalist Sanya Richards-Ross goes for another gold. You’ll also see the men’s 110 meter hurdles, where American Aries Merritt had the fastest first round time yesterday. The US men’s basketball team is four wins away from a gold medal. Their quarterfinal today pits them against Australia, a surprise qualifier that features former Husker star Aleks Maric.

Rockies Win Second Straight in LA (LISTEN LIVE TONIGHT on ESPN Radio 1410)

Another strong effort from the mound and a torrid performance from a rookie sensation propelled the Colorado Rockies to a 3-1 win over the Los Angeles Dodgers last night in Los Angeles. After four pitchers shut out the Dodgers on Monday on five hits, the Rockies used five pitchers in a four-hitter, with Josh Roenicke’s three innings of shutout relief earning him the victory. Offensively, rookie shortstop Josh Rutledge continued his hot hitting. He had four hits on the night, including three doubles, and drove in all three of Colorado’s runs. The series win for the Rockies at Dodger Stadium is a first since September of 2010. The Rockies will go for a rare road sweep of their division rivals tonight. Husker Camp Update – Veteran Defensive Line Hopes to Improve on Disappointing 2011

LINCOLN, NE (AP) — First-year defensive coordinator John Papuchis says one of Nebraska’s top priorities is to shore up a line that has been underperforming. Opponents last season rushed for the second-most yards against the Cornhuskers since 1977, and Nebraska recorded its second-fewest sacks since the statistic was first officially tracked in 1981. Ends Cameron Meredith and Jason Ankrah and tackle Baker Steinkuhler have locked up three of the four starting jobs. With those three starting nine games together last season, Nebraska allowed an average of 158 yards on the ground to rank 64th nationally. That number ballooned to 176 yards against Big Ten opponents. Only 11 of the Huskers’ 21 sacks came in the eight conference games. Meredith said new line coach Rick Kaczenski is stressing the importance of playing aggressively.

Dumervil Avoids Criminal Charges Stemming From Road Rage Incident Last Month

ENGLEWOOD, Colo. (AP) — Pro Bowl defensive end Elvis Dumervil of the Denver Broncos won’t be charged in a road rage incident in Miami Beach, Fla.

His lawyer, Harvey Steinberg, said the Miami-Dade County state’s attorney informed him Tuesday that Dumervil had been cleared in the case. Dumervil had been arrested on a charge of aggravated assault with a deadly weapon.

A relieved Dumervil said he knew he “didn’t do anything wrong” but was “in the wrong place at the wrong time.”

The police report said Dumervil and another man were stuck in traffic on July 14, got into an argument with a female driver, and the two men displayed weapons. Dumervil told police he didn’t have a gun; officers say they found one in the car’s glove compartment.

Broncos Training Camp Update – Manning Gears Up For Debut and A Touching Gesture For a Teammate

ENGLEWOOD, Colo. (AP) — Peyton Manning and the Denver Broncos are treating their visit to Chicago on Thursday night just like any other preseason opener.

Only, it isn’t.

This marks the four-time MVP’s first game of any sort since Jan. 30, 2011, when he went 2-for-5 for 12 yards and an interception in the AFC’s 55-41 loss to the NFC in the Pro Bowl.

Manning missed all of last season with a nerve injury in his neck that weakened his throwing arm and led to his release from Indianapolis, setting off the biggest free agent frenzy in NFL history.

He’s looked like the Manning of old ever since landing in Denver. Even on Tuesday, when he had several incompletions at practice against an ever-improving defense, Manning’s decision-making was sharp.

Elsewhere, several of Ben Garland’s teammates gathered around him after the Denver Broncos’ practice Tuesday morning and gave him two replacement silver sabers he received upon graduating from the Air Force Academy, along with a Falcons football helmet.

The originals were lost in the wildfire that destroyed his grandparents’ home in Colorado Springs this summer.

He was presented with the shiny swords by William “T” Thompson of the Association of Graduates at the U.S. Air Force Academy. Then, linebacker Joe Mays gave him a new college helmet, white with a blue lightning bolt.

Mays said the Broncos wanted to do something for Garland after all he went through.

Foster mother engages in a sexual relationship with her foster son for two years

LINCOLN, Neb. (AP) — A Lincoln woman accused of having a sexual relationship with one of her foster children has been charged with one count of felony child abuse.

The 29-year-old woman was arrested last month. She faces arraignment in Lancaster County District Court on Aug. 15.

The Associated Press is not naming the woman to protect the identity of her foster son.

Police say the sexual relationship began in October 2010, when the boy was 17, and lasted two years. The now-19-year-old man told police in May about the relationship.

Police say the woman told investigators she began having sex with the teenager after her husband left her.

Authorities say two other foster children were taken from the woman’s home when she was arrested.

Norfolk woman sentenced for hiding suspect in home

NORFOLK, Neb. (AP) — A 38-year-old Stanton woman has been given 60 days in jail for helping a suspect hide from authorities.

Connie Mandl was sentenced on Monday.

Authorities say Mandl owns the Stanton home where 34-year-old Carlos Arevalo-Martinez hid and held police at bay following a shooting in Norfolk on Feb. 14. Edna Gutierrez, of Norfolk, was wounded.

Arevalo-Martinez has pleaded not guilty to assault and a firearms charge. His trial is scheduled to begin on Sept. 4.

Brother receiving Social Security becomes employed by brother for family business, convicted of fruad

OMAHA, Neb. (AP) — Authorities say two Nebraska brothers have been convicted of conspiracy and theft in a case of Social Security fraud.

A news release from the office of U.S. Attorney Deborah Gilg  says a jury convicted 51-year-old Timothy Shirley of conspiracy, theft and Social Security fraud. Forty-eight-year-old Matthew Shirley was convicted of conspiracy and theft.

They are scheduled to be sentenced on Oct. 29.

Prosecutors say that from 2004 to 2010, Matthew Shirley managed a family trucking company called Mare Inc. in Nebraska City. He employed Timothy Shirley although he knew his brother was receiving Social Security disability benefits.

Prosecutors say Timothy Shirley got about $135,000 in benefits he was not entitled to receive.
