Nebraska Man Convicted in Grandson’s Death to Get New Trial

OMAHA, Neb. (AP) — The Nebraska Supreme Court has ordered a new trial for a man convicted of beating his grandson to death.

Peter Draper, of Franklin, was found guilty last May of two child abuse counts in the April 2012 death of 2-year-old Joseph Rinehart Jr. and sentenced to a minimum of 109 years in prison.

Draper appealed, saying the trial court should not have allowed his wife to be called as a witness by prosecutors.

On Friday, the high court sided with Draper, noting that his wife, Nancy Draper, invoked her right against self-incrimination on the stand. The high court also noted that prosecutors asked her several leading questions implicating Peter Draper in the death and that the trial judge refused to instruct the jury to disregard his wife’s testimony.

Opposition Leader Kleeb Blasts Nebraska Court Decision

ne-supreme-courtLINCOLN, Neb. (AP) — The director of a group leading opposition to the proposed Keystone XL pipeline is denouncing the Nebraska Supreme Court’s tossing of a lawsuit over it.

Jane Kleeb, executive director of Bold Nebraska, sobbed Friday morning following the release of the court’s opinion throwing out the lawsuit, even though a majority of judges agreed that the landowners who sued should have won their case.

Because it raised a constitutional question, a supermajority of five judges was needed to rule on the law. But three justices found that the landowners didn’t prove they had standing to file the lawsuit.

Kleeb says she is still confident the White House will not approve federal permits needed to build the pipeline, but says opponents will consider other ways to try to block the project.

Trev Alberts Elected to College Football Hall of Fame

Trev Alberts Nebraska Huskers FootballNebraska great Trev Alberts is among 17 standout student-athletes and coaches who are part of the 2015 College Football Hall of Fame class. The 2015 list of inductees was announced on Friday in Dallas by the National Football Foundation and College Hall of Fame.

Alberts will become the 17th Nebraska player in the College Football Hall of Fame, along with six former Cornhusker coaches. He and the other members of the 2015 Hall of Fame class will officially be inducted in New York City on Dec. 8. Alberts is the fourth Husker in the past seven years to be named to the Hall, joining 2013 inductee Tommie Frazier, 2011 honoree Will Shields and 2009 inductee Grant Wistrom.

Alberts currently serves at the Director of Athletics at the University of Nebraska-Omaha, and said the honor is a result of a team effort at Nebraska.

“I am humbled to be selected to the College Football Hall of Fame, and honored to be able to represent the University of Nebraska and all of those who supported my student-athlete experience,” Alberts said.

“I had the great privilege of being surrounded by others who made a ‘Hall of Fame’ difference in my life, including my family, teammates and a true Hall of Famer—Coach Tom Osborne.”

Alberts joins Osborne in the College Football Hall of Fame. The former Nebraska head coach was inducted immediately following his retirement in 1998. Osborne said Alberts is a worthy Hall of Fame selection.

“Trev was one of the greatest pass rushers I have seen,” Osborne said. “He had a tremendous first step, was explosive off the ball, played with high intensity and was a very intelligent football player. We switched to a 4-3 defense while Trev was here and that really helped him as a player, and that had a tremendous impact on our success as a defense. He was a great asset for our program and had a great career for us.”

Alberts completed his Nebraska career with one of the finest defensive seasons in school history in 1993. Alberts won the Butkus Award and led Nebraska to an undefeated regular season and an appearance in the Orange Bowl against Florida State, where NU fell just short of a national title. Osborne noted that Alberts’ dominant senior season played a key part in Nebraska’s run of success from 1993 to 1997.

“Trev played on a team (1993) that played at a high enough level to win a national championship and certainly could have won it,” Osborne said. “I felt bad that Trev wasn’t one of of those national championship teams. He was one of the guys that was instrumental in putting us in position to win national championships.”

As a senior co-captain in 1993, the Cedar Falls, Iowa, native was named the Big Eight’s defensive MVP. Alberts led the Huskers with 96 tackles, including 47 solo stops, and tied a school record with 15 sacks for 88 yards. He also had 21 tackles for 99 yards lost, three fumbles caused, one pass breakup and 38 quarterback hurries, all of which were team highs.

Alberts recorded eight double-figure tackle games and had at least one sack in nine games. In the final regular-season game, he dislocated his elbow, but returned to play in the Orange Bowl, where he had six tackles, including three sacks for 29 yards lost, and three quarterback hurries, earning defensive MVP honors in the Huskers’ 18-16 loss to FSU.

For his performance, Alberts was named a first-team All-American by every major publication and was named the Football News National Defensive Player of the Year, Big Eight Defensive Player of the Year and the Big Eight Male Athlete of the Year. His No. 34 jersey was retired at the 1994 Spring Game.

In 1992, Alberts totaled 73 tackles, including 11 tackles for loss, as he earned first-team All-Big Eight and second-team All-America honors. As a freshman in 1990, he was the Big Eight Defensive Newcomer of the Year, making 26 tackles, including four sacks.

Alberts holds the school record for career sacks with 29.5 (196 yards lost) and ranks fourth in school history with 45 tackles for loss (242 yards). He also had five fumbles caused, five recovered fumbles, six pass breakups and 69 quarterback hurries in his Husker career. His 248 tackles rank 11th on Nebraska’s all-time chart.

Off the field, Alberts was equally honored, earning the NCAA’s highest honor, The Today’s Top Six Award, in 1993. A three-time academic All-Big Eight honoree, Alberts earned postgraduate scholarships from the National Football Foundation and Hall of Fame, NACDA Disney, the NCAA and the Big Eight. A CoSIDA Academic All-American in 1993, he graduated from Nebraska before his senior season.

Alberts was the fifth pick in the 1994 NFL Draft by the Indianapolis Colts and played for the Colts until 1996. He served as a college football analyst for several national television networks before moving into athletic administration at Omaha.

Alberts has been the Mavericks’ Director of Athletics since April of 2009. During his tenure he has directed significant advancements in the areas of academic success, business, facilities, conference affiliation and rebranding for Omaha Athletics, and he has the Mavericks poised for full Division I membership in 2015-16.

Police Officials: 4 Dead in Paris Grocery Hostage Crisis

police-lights-redPARIS (AP) — Two police officials say at least four people, including the attacker, have died at a kosher grocery in Paris where a gunman took several hostages.

Security forces stormed the grocery minutes after their counterparts assaulted the building outside Paris where two brothers suspected in the Charlie Hebdo killings had holed up.

The two police officials, who could not be named speaking about the quickly developing situation, confirmed the attacker died. One of the officials said three of the dead were hostages.

The gunman has been identified as Amedy Coulibaly.

None of the officials could say what has happened to the woman listed on a police bulletin as his accomplice.

Nebraska High Court Tosses Suit Over Keystone Pipeline Route

keystoneLINCOLN, Neb. (AP) — Nebraska’s highest court has tossed a lawsuit challenging a proposed route for the Keystone XL oil pipeline.

The decision released Friday by the state Supreme Court upholds a 2012 state law that allowed the governor to empower Canada-based TransCanada to force eastern Nebraska landowners to sell their property for the project.

Four judges on the seven-judge court agreed that the landowners had legal standing to bring their case. But because the case raised a constitutional question, a super-majority of five judges was needed.

President Barack Obama has said he was waiting for the Nebraska ruling before making major decisions for the pipeline, which would carry more than 800,000 barrels of oil a day from Canada to Texas refineries.

Republicans say the pipeline is a top congressional priority.

Iginla Scores 2 Goals as Avalanche Beats Senators 5-2

Colorado-Avalanche-LogoDENVER (AP) — Jarome Iginla scored twice and the Colorado Avalanche beat the Ottawa Senators 5-2 on Thursday night.

Semyon Varlamov followed up his 54-save shutout at Chicago with 36 saves for the Avalanche, who have won four of five. Erik Johnson, Brad Stuart and Daniel Briere also had goals for Colorado.

Iginla got the Avalanche on the board first with his 11th goal of the season. He took a pass from Alex Tanguay down low, circled around and beat Craig Anderson with a wrister at 8:20 of the first period.

His goal just 23 seconds into the third period made it a 4-1 game. It was Iginla’s 572nd career goal and moved him within one of Mike Bossy for 20th on the NHL’s career list.

Nebraska Pulls Away for 65-49 Win over Cold-Shooting Rutgers

Nebraska-Huskers-BasketballLINCOLN, Neb. (AP) — Terran Petteway scored 20 points and Shavon Shields added 11, and Nebraska pulled away from Rutgers in the second half for a 65-49 victory Thursday night.

The Huskers (9-6, 1-2) are off to their best start in Big Ten play in their four years in the conference. Their previous starts were 0-4, 0-5 and 0-4.

Rutgers (9-6, 1-2) shot 34.7 percent and turned the ball over 19 times in its first-ever Big Ten road game. The Knights led by seven points early, but the lowest-scoring and worst-shooting team in the league struggled mightily after the opening 10 minutes.

Benny Parker and Walter Pitchford added nine points apiece for the Huskers.

Bishop Daniels had 12 points and Kadeem Jack had 11 for Rutgers.

Cady lifts No. 19 Nebraska over Michigan St. 71-67

Nebraska-Huskers-BasketballEAST LANSING, Mich. (AP) — Emily Cady scored 16 points, including a go-ahead three-point play with 30 seconds remaining and No. 19 Nebraska beat Michigan State 71-67 on Thursday night.

The victory was the first in Big Ten play for the Cornhuskers (11-3, 1-2) after dropping their first two conference games.

Michigan State’s Aerial Powers had seven 3-pointers on her way to 35 points, a total that tied her for second-most behind a school-record 41 by Maxann Reese in 1999. Powers also had 11 rebounds.

Nebraska trailed 66-60 with three minutes left when it went on an 11-1 run to finish the game. Cady’s layup and foul shot gave Nebraska a 69-67 lead and after Michigan State missed a 3-pointer, Hailie Sample closed out the scoring with a pair of free throws with five seconds left.

The Cornhuskers survived a 3-of-18 night from behind the arc, outscoring Michigan State in the paint 38-16.

Gov. Ricketts Asks for Moment of Silence in Legislative Aide’s Death

lincoln-policeLINCOLN, Neb. (AP) — Nebraska Gov. Pete Ricketts asked for a moment of silence before his inaugural speech after authorities say a 36-year-old legislative aide died in a fall from an apartment building this week.

The man who worked for 15 years for the Nebraska Legislature was pronounced dead the scene on Thursday. Police say they are investigating his death as a suicide.

His family said in a statement that he struggled with depression and a bipolar disorder as an adult. Their statement said that if anything positive can come from his tragic death, then he would want to raise awareness for mental illness and those who struggle with it.

Ricketts was sworn into office as the 40th governor of Nebraska on Thursday.
