Panel dismisses complaint against Nebraska Sen. Chambers

senator-ernie-chambersLINCOLN, Neb. (AP) — A state panel has dismissed a complaint alleging that Nebraska Sen. Ernie Chambers misused public resources when he ridiculed another lawmaker with drawings and poems on state letterhead.

The Nebraska Accountability and Disclosure Commission voted 7-0 on Friday not to investigate the complaint by Andrew Sullivan, a conservative activist from Omaha.

Chambers has released more than two dozen memos calling attention to state Sen. Bill Kintner’s use of a state computer to have cybersex with a woman he met online. Kintner was fined $1,000 for misuse of state property. The memos, dubbed “Kintner-grams,” include unflattering drawings of Kintner and rhymes mocking his indiscretion.

Commission member Jeff Peetz says he doesn’t condone Chambers’ memos, but notes that Kintner’s behavior was a matter of public concern.

Nebraska high court upholds Sidney man’s murder conviction

SIDNEY, Neb. (AP) — The Nebraska Supreme Court has upheld the first-degree murder conviction of a man for killing a 30-year-old Sidney woman.

Larry Martinez was sentenced to life in prison for the murder charge, as well as 10 to 50 years in prison for a gun count in the July 2012 shooting death of Mandy Kershman, whom he had been dating. Prosecutors say Martinez shot Kershman over a text message she had sent him.

In his appeal, Martinez argued that the trial court erred by denying a motion to suppress statements he made to police. He also said he should not have been found competent to stand trial and that instructions to the jury were flawed.

The high court on Friday found all of Martinez’s arguments were without merit.

Sex offender pleads guilty to assaulting 12-year-old Nebraska girl

sex-offendersNEBRASKA CITY, Neb. (AP) — A convicted sex offender has pleaded guilty to sexually assaulting a 12-year-old girl less than a year after he left a Nebraska prison.

Online court records say 23-year-old Nebraska City resident Preston Boehnke pleaded guilty Tuesday in a deal with prosecutors. A second count was dropped in exchange for Boehnke’s plea. A sex offender specific psychological evaluation will be completed before his sentencing, which is scheduled for Jan. 10.

Boehnke was sentenced in 2013 to three to five years in prison for possession of child pornography. He was released from custody in July 2015. Court records say the sex assault occurred April 1 this year.

More residents near ammonia leak site allowed to go home

decatur-nebraskaDECATUR, Neb. (AP) — More northeast Nebraska residents are being allowed to return to their homes days after they were evacuated because of an anhydrous ammonia leak that killed a local farmer.

Magellan Midstream Partners, of Tulsa, Oklahoma, said Friday that it is still not allowing people who live within a mile from where the pipeline leak occurred to return home. Magellan says only four homes fall within the mile radius.

Magellan has been repairing the 8-inch-diameter pipeline that carries the liquid fertilizer. When released from a tank or pipe, anhydrous ammonia becomes a lethal gas that can cause severe chemical burns and damage the tissue of the eyes, nose, throat and lungs.

Authorities have said 59-year-old Phillip Hennig, of Tekamah, was killed by the fumes Monday night while checking on the leak.

Phillip was born on March 15, 1946 in Yuma, CO to Floyd E. and Nellie Frances (Ellis) Brown. After graduating high school in Benkelman in 1964 he married Bernice Schuller in 1975 in Oberlin, KS where they resided. Over the years he held various jobs including farm work, truck driving, was employed at a cement company in McCook, and retired from Walmart Distribution Center in North Platte. He will be remembered as a helpful person to his family and friends and as a guy with an ornery streak about him.
Phillip is survived by his children, Roy (Kathleen) Brown of Sacramento, CA, Nathan (Annie) Brown of Sacramento, CA, Patty (Warren) Schwartz of North Platte; numerous grandchildren and great grandchildren; brother Gerald (Beth Hampton) Brown of North Platte; as well as numerous other family members and friends.
He was preceded in death by his parents; and wife Bernice.

Evelyn R. Teall, 90, of North Platte, passed away Oct. 20, 2016 at her home. She was born Dec. 12, 1925 to Iral W. and Francis M. (Knowles) Norris at Quincy, Michigan. She attended Litchfield High School in Michigan. Evelyn was united in marriage to Robert A. Teall on March 1, 1944 at Litchfield.
She is survived by her daughter, Janice L. Carskadon of Columbus; two sons, Robert W. Teall of North Platte and Dennis C. Teall, Sr. of Brule; eight grandchildren; 12 great grandchildren; and six great-great grandchildren.
She was preceded in death by her parents; sisters, Virginia Sloan and Katheryn Meiers; brothers, James Norris and William Norris; daughter-in-law, Helen Teall; son-in-law, Clay Carskadon; nieces, Jackie Sloan and Amy Norris; and a nephew, Kenneth Norris.

Virginia L. Humphrey, 85, of North Platte, passed away Oct. 16, 2016 at her home. She was born Aug. 17, 1931 to Richard and Edna (Johnson) Humphrey at Sutherland, NE. Virginia graduated from North Platte High School with the class of “49”. She taught school in a one room classroom outside of Sutherland after graduation. Virginia also was employed as a LPN, worked at the North Platte Library and FAA at the airport. She is survived by her niece, Rachael Sabata of Omaha; nephews, Russell Ward of Georgia and Richard Ward of Florida; a great niece, Michelle Sharp of Omaha; numerous other great nieces and nephews; a cousin, Gordon Sanders of Cozad; and other relatives. She was preceded in death by her parents; a sister and brother-in-law, Ardis (Elmer) Ward; and a nephew, Keith Ward. Online condolences may be shared at www.carpentermemorial.com. Sharon Lee Smidt, 74, of North Platte, passed away peacefully in her home on October 19.
Sharon was born in Standish, Michigan to Jim and Maurine Ross on December 20, 1941. She graduated with a teaching degree from UNL in Lincoln, Nebraska and married her one true love, Maynard, on April 14, 1964. Sharon worked as a mother and homemaker, dedicating her life to raising her three children. She attended every sporting event and never missed a parent/teacher conference. Always thinking of others, Sharon dedicated many years of her life volunteering at Great Plains Medical Center. She was a loving and devoted grandma, making each birthday and holiday special by sending her grandchildren carefully chosen care packages. Sharon was an avid reader and always enjoyed a good game of Trivia Crack and Words with Friends with her sisters, friends, and family. A Husker fan for her entire life, she enjoyed cheering on the football and volleyball team. Sharon’s life was rich as it revolved around her family, the people she loved most. Sharon leaves to cherish her loving memory, her husband, Maynard Smidt; her children, Kim Ridder of Lincoln, Kristi Murphy of Omaha and Jeff Smidt of Denver; Sisters, Margaret Honeycutt of Lincoln and Kathy Mischnick of Eagan, Minnesota; 4 grandchildren and a host of nieces, nephews, cousins, and friends. US confirms 11th death due to Takata air bags

airbagDETROIT (AP) — The U.S. government is confirming another death due to the rupture of an air bag made by Takata Corp.

The National Highway Traffic Safety Administration says a 50-year-old woman died Sept. 30 in Riverside County, California.

Honda Motor Co. confirmed the woman’s death and said she was driving a 2001 Civic.

This is the 11th known U.S. fatality attributed to Takata air bags.

The air bags can inflate with too much force, which causes their metal interior to rupture and spew shrapnel into the vehicle.

The problem touched off what is now the largest auto recall in U.S. history. More than 69 million inflators have been recalled in the U.S. and more than 100 million worldwide.
