Defense begins its case in murder trial of former doctor

OMAHA, Neb. (AP) — The defense has begun its case in the trial of a former doctor accused of killing four people with ties to an Omaha medical school.

Defense attorneys for Anthony Garcia called several witnesses Thursday, including an expert who testified that a gun magazine found at the home of Dr. Roger Brumback and his wife, Mary, showed extensive wear and did not appear to be new.

The testimony is intended to counter prosecutors’ assertions that the magazine was part of a handgun Garcia had purchased two months before the Brumbacks were killed in 2013.

Prosecutors say Garcia killed the Brumbacks, as well as the 11-year-old son of another Creighton University School of Medicine faculty member, Dr. William Hunter, and the family’s housekeeper in 2008.

The Post has confirmed through family that the fire claimed the lives of a family of six.

Killed in the tragedy were Michelle Collins Speer, her husband Mike and their four daughters, Elli, Adilynn, Emma and Anniston.

Michelle is a 1998 graduate of North Platte High School.  The oldest child, Elli, 11, was also the daughter of 1997 NPHS graduate James Perez.

NEHAWKA, Neb. (AP) — Officials say a fire in rural southeastern Nebraska has left more than one person dead, but say they are unable to yet determine how many have been killed.

The Nebraska Fire Marshal’s Office says firefighters were called shortly after midnight Wednesday to a house near the village of Nehawka in Cass County by a neighbor. The neighbor reported a fire with people still inside the home.

The Fire Marshal’s Office says its investigators were still on the scene Thursday afternoon, noting there have been “multiple fire fatalities,” but can’t confirm a specific number. Investigators have ordered autopsies to identify remains as they are found.

The Cass County Sheriff’s Office and County Attorney are helping with the investigation. Both of those departments referred questions Thursday to the Fire Marshal’s Office.

Staffer assaulted at women’s prison, Nebraska officials say

YORK, Neb. (AP) — Authorities say a staff member was attacked by an inmate at the Nebraska Correctional Center for Women in York.

The Nebraska Correctional Services Department says the staffer deflected an attempted blow Wednesday from the prisoner, who was wielding a handmade weapon. The inmate then grabbed the staffer’s hair and made contact with the staffer’s face before other staff members could stop the assault.

The staff member was treated for minor injuries.

The department says the names of those involved won’t be released. Results of an investigation will be given to the York County attorney for a decision about prosecution.

Wounded man driving to hospital hit school bus, police say

omaha-policeOMAHA, Neb. (AP) — Authorities say a wounded man struck a school bus as he was driving to an Omaha hospital.

The shooting occurred around 4:30 p.m. Wednesday in northeast Omaha. Police say 25-year-old Jestun Haynie was sitting in the car in a driveway when someone in another vehicle drove by and shot him. He was about two miles from the shooting site when his car hit the school bus. Police say the bus driver and none of the children were injured.

Haynie was treated at Creighton University Medical Center and then taken to jail on an unrelated warrant and on suspicion of traffic violations. Online court records don’t list the name of an attorney who could comment for Haynie.

Deer hunter accidentally shoots himself in western Iowa

ambulance-lightsDENISON, Iowa (AP) — Authorities say a 51-year-old man accidentally shot himself on his way into a western Iowa field to hunt deer with his wife.

The shooting occurred around 5 p.m. Monday in southern Crawford County. The Iowa Natural Resources Department says Daniel Gehling, of Denison, was adjusting the handgun in his waistband when it went off. The bullet struck one of his thighs. The department says his wife, Carolyn, called for help and applied pressure on the wound to stanch the bleeding.

Daniel Gehling was taken to Crawford County Memorial Hospital in Denison for treatment and then flown to an Omaha, Nebraska, hospital for surgery.

Texas homicide suspect captured in south-central Nebraska

us-marshalsGRAND ISLAND, Neb. (AP) — Authorities in south-central Nebraska have captured a man sought in a Texas homicide.

The U.S. Marshals Service says 30-year-old Jose Rivera, of Houston, was arrested without incident Tuesday night in Grand Island. He’s suspected in a fatal shooting during a January 2015 robbery at a convenience store in Houston. Authorities say a multiagency task force developed information that Rivera was at the Grand Island address where he was picked up.

Online records said Rivera remained in Hall County Jail on Thursday morning. It’s unclear whether Rivera has attorney who could comment on his behalf and whether Rivera will fight extradition to Texas.

Car driver killed in collision with SUV, authorities say

fatal-crashRICHLAND, Neb. (AP) — Authorities say a car driver has been killed in a Colfax County collision with a sport utility vehicle.

The crash occurred around 6 a.m. Thursday, about three miles east of Richland on U.S. Highway 30. The Colfax County attorney’s office says a mechanical problem caused the eastbound SUV to go out of control, cross into oncoming traffic and hit the car head-on.

The car driver was pronounced dead at the scene and a passenger was taken to a hospital. The SUV driver also was hospitalized.

Authorities haven’t released the names of those involved.

Group wants Nebraska to suspend facial recognition use

aclu-nebLINCOLN, Neb. (AP) — The American Civil Liberties Union of Nebraska wants two Nebraska law enforcement agencies to suspend the use of facial recognition technology in their investigations until lawmakers and the public can weigh in on the practice.

A recent report from Georgetown University about the technology’s use includes the Lincoln Police Department and Nebraska State Patrol. The two agencies access the Nebraska Department of Motor Vehicles’ system for facial recognition.

The ACLU of Nebraska says more public vetting is needed to prevent misuse and abuse of the technology.

Lincoln public safety director Tom Casady says facial recognition technology is an efficient tool for identity theft investigations, and there are restrictions in place to allow its use by only a few investigators from each law enforcement agency.

The state patrol says it’s reviewing the university’s report.

4 firefighters injured battling southwest Nebraska blaze

fireCULBERTSON, Neb. (AP) — Authorities say four firefighters have been injured battling a field blaze in southwest Nebraska.

Red Willow Western Rural Fire Department firefighter Billie Cole said one of the four was treated at Community Hospital in McCook for burns on his face and arms. She says the other three suffered lesser burns and were not hospitalized.

The department had joined the Culbertson department in fighting the fire Monday. Officials say the wind kicked up and spread flames from a burning pile of rotten lumber at a farmstead demolition project northwest of Culbertson.

Culbertson Fire Chief Rich Sensel says the blaze blackened nearly 260 acres of corn stubble, conservation land and trees. Nearly 60 firefighters responded.

Roger W. Sprague, 73, of North Platte passed away October 18, 2016 at his home.
Roger was born November 13, 1942, in North Platte to Wilmer and Margaretta (Prosise) Sprague. He grew up in North Platte, where he attended North Platte Public Schools. Roger enlisted in the United States Army, being stationed in Germany, and later being transferred to the National Guard. He worked for the City of North Platte and at the Rock Island Railroad out of Chicago. He hired on the UPFE in 1968. On April 29, 1969 he married Kathy McEntire in North Platte. To this union were born two daughters. In 1985 he was promoted to foreman, retiring in 2002.
Roger’s hobbies were amateur ham radio, and golfing with his friends and grandsons. He was a whiz at electronics, and was a man who loved his children, grandchildren, and great-grandchildren.
Survivors include his wife Kathy of North Platte; daughter, Liane Sprague of North Platte; grandchildren, Trent, Tyler, and Quentin of North Platte, Tyrel of Oklahoma City, and Christian and Rylea Diaz of North Platte; great-grandchildren, Tatum, Braelynn, and EverLeigh; sisters, Betty Nichols, Julie (Tony) Pitre, and Donna Cross; and several other family members.
He was preceded in death by his parents; infant daughter, Kim, and daughter Michelle Diaz; infant son, Brent; granddaughter, Cydney Diaz; and brothers, Steve, and Harold.

Services will be 10:00 a.m. Monday, October 24, 2016 at Adams & Swanson Funeral Home with Joe Chitwood presiding. Visitation will be 12:00 p.m. – 6:00 p.m. Saturday and Sunday with the family receiving friends 4:00 p.m. – 6:00 p.m. on Sunday at Adams & Swanson Funeral Home which is in charge of arrangements.
