Ruling favors Nebraska utility in power line survey case

powerlinesTHEDFORD, Neb. (AP) — A judge has ordered a family ranch to let Nebraska Public Power District access its land for survey work.

Court records say the ruling came Monday in the Brush Creek Ranch lawsuit against the district. The lawsuit sought unspecified compensation for damage to land north of Thedford that was done by a survey team checking land boundaries for a power line project.

The district said Nebraska law gave it the authority as a publicly owned utility to survey the ranch and other land. The lawsuit said the utility first should have begun condemnation proceedings and obtained court authority for the survey.

The judge ruled for the district, saying the law indeed gave it authority to enter the land and also required it to pay for any damage caused the incursion.

Nebraska prison on lockdown after 9 staff members assaulted

prisonLINCOLN, Neb. (AP) — Prison officials in Nebraska say nine staff members at the Lincoln Correctional Center have been assaulted by inmates who were refusing to return to their cells.

Department of Correctional Services spokeswoman Dawn-Renee Smith told The Associated Press in an email Wednesday night that all nine were taken to hospitals after the attack and have been treated and released.

The prison has been placed on lockdown. It’s not clear how many inmates were involved in the Wednesday evening attack or whether any were hurt.

The Lincoln Correctional Center is a medium-maximum security prison for adult males.

Coy V. Thomlison, age 89 of North Platte, passed away August 23, 2016 at Regional West Medical Center in Scottsbluff. He was born December 21, 1926 at Middlebrook, MO to Albert M. and Lulah Belle (Strickland) Thomlinson. Coy grew up in Missouri attending school in Ironton and was united in marriage to Evelyn Marie Bockus on November 18, 1944 at Oberlin, KS. He served in the United States Army until his discharge in 1946. He hired out on the UPRR as a brakeman-conductor and also owned and operated a shoe shop along with being a barber and doing custom haying. So it could be said that he was a jack of all trades and master of many. Coy was a member of the Lions, American Legion, Eagles, and VFW. His loving family includes his wife; Evelyn of North Platte, sons; Steven (Becki) Thomlison of Scottsbluff, Micheal (Kathy) Thomlison, and Patrick (Patricia) Thomlison both of North Platte, daughter-in-law; Sheila Thomlison of North Platte, 13 grandchildren, 27 great-grandchildren, 2 great-great grandchildren, many nieces, nephews, and friends. He was preceded in death by his parents, 15 brothers and sisters, son, Tom Thomlison, grandson, Robert (Bob) Thomlison, and a great-grandson, Derick. Services will be 10:30 am Friday, August 26, 2016 at Carpenter Memorial Chapel. Burial will be at Floral Lawns Memorial Gardens with military honors. Memorials are suggested to the North Platte Senior Center. Visitation will be 1 to 8 pm Thursday with family receiving friends from 7 to 8pm at the funeral home. Grand Island approves project for hospital, hotel

grand-island-beefGRAND ISLAND, Neb. (AP) — The Grand Island City Council has rezoned 100 acres of land at two highways and has authorized $28.7 million of tax-increment financing for a new development that includes the construction of a second hospital in the city.

Prataria Ventures, a subsidiary of Chief Industries, proposed the Prairie Commons project’s first phase, which would cost $126 million for a 64-bed hospital, a three-story medical office building and 110-bed hotel and conference center. The structures would all be connected with walkways.

Councilman Mark Stelk says having additional health care options and development in the community is vital.

But Councilman Roger Steele says he thinks Chief Industries is relying too much on public support and that public funds should only be used for essential costs.

Police: Woman attacked in her Lincoln apartment by intruder

lincoln-policeLINCOLN, Neb. (AP) — Police are searching for a suspect after a 21-year-old Lincoln woman reported being beaten and sexually assaulted by an intruder who broke into her home.

The attack occurred in northeast Lincoln just after 5 a.m. Wednesday. The woman told police she was asleep in the living room of her apartment when she awoke to a man armed with a knife.

She says he initially demanded her belongings before attacking her. She was taken to a hospital with visible bruising and swelling to her face.

Police say the only description they have of the suspect is that he was wearing dark clothing.

Investigators believe the man may have entered the apartment through an unlocked window.

3 arrested in Douglas County when 22 lbs. of pot, 1 lb. of meth found

douglas-county-sheriffOMAHA, Neb. (AP) — Three people are facing charges after Douglas County Sheriff’s deputies found 22 pounds of marijuana and 1 pound of methamphetamine in two different traffic stops this week.

The sheriff’s office says both stops occurred within several hours of each other on Interstate 80.

In the first incident Tuesday night, a driver was stopped on I-80 near 96th Street for a traffic violation. A sheriff’s deputy smelled marijuana and found the drug bundled in three bags in the trunk.

A 51-year-old California man was arrested in that stop.

Then early Wednesday, a police dog detected the odor of drugs coming from a vehicle another deputy had stopped on I-80. A search found the methamphetamine in the vehicle.

A 54-year-old woman and her 33-year-old passenger were arrested. Both are from New Hampshire.

Roger Duane Brooks

Roger Duane Brooks, age 61 of North Platte, passed away at his home on Tuesday after a brief and courageous battle with pancreatic cancer on August 23, 2016.
Roger was born on May 27, 1955 in Arnold, NE to Lawrence and Mabel (Wood) Brooks. He moved to Brady with his parents in 1960, then to Ogallala in 1966, where he graduated from the Lutheran High School. After high school he served in the United States Army and was always proud to talk about his time serving in Germany. After returning from the Army he settled in North Platte where he began his career with Union Pacific Railroad. He had everlasting friendships after his 37 years at UPRR from which he retired in August of last year.
Roger was a devoted family man. He was committed to his kids and his family and loved spending time with his children, grandchildren and nephew Gary. He relished in woodworking, fishing, helping his friends or family whenever he could, and traveling with Deb.
Roger is survived by his wife Deb of North Platte; 3 children, Jason Brooks (Jessica) of Lincoln, Loni (Case) Waddell of Omaha, and Tyler Brooks (Gail) Brooks of Omaha; 2 stepchildren, Jeffrey Nelson (Meredith) of Colorado Springs, and Timothy (Jamie) Nelson of Navarre, Fl; his mother Mabel Brooks of North Platte; siblings, Orrin (Barb) Brooks of North Platte, and Gloria (Darwin) Grooms of Bassett; 16 grandchildren and numerous other family members and friends.
He was preceded in death by his father, Lawrence Brooks; an infant brother, George Frederick “Buddy” Brooks.
