Man’s Charges in Omaha Bridge Slaying Dropped

gavel-more(AP) — Prosecutors say they’ve dropped murder and assault charges filed against a man after a shooting on the pedestrian bridge that connects Omaha with Council Bluffs, Iowa.

Douglas County Attorney Don Kleine said Thursday that witnesses were evasive or otherwise uncooperative with investigators and prosecutors, so the case against 24-year-old Terrece Cox became impossible to prosecute. Cox’s trial was scheduled to begin on Monday. He has maintained his innocence throughout the investigation.

Cox was charged with second-degree murder and other charges after the May 29 shooting death of 26-year-old Shamari Richards on the Bob Kerrey Pedestrian Bridge. The other people were wounded.

Billy Kellogg was charged with being an accessory to a felony. It’s unclear whether his charges will be dropped as well.

(AP) — An Omaha woman has been sentenced to 11 years in prison after being convicted of pulling a gun on a paramedic.

Twenty-four-year-old Justine Dubois received the sentence Friday in Douglas County District Court. She must serve more than nine years before she is eligible for release.

As part of a plea bargain, Dubois pleaded no contest in November to several charges in relation to the July 1 shooting.

Prosecutors say Dubois faked a seizure while being arrested for allegedly stealing a car. In an ambulance taking her to a hospital, she pulled a gun and started making threats. Police say two shots were fired as Dubois and a paramedic struggled over the gun.

One shot hit Dubois in the leg. The other shot caused minor wounds to the paramedic’s abdomen.

Nebraskan Appeals Conviction in Baby’s Death

Ryan-Kozisek(AP) — A 32-year-old eastern Nebraska man found guilty of killing his 4-month-old daughter has appealed his conviction.

Ryan Kozisek’s filing earlier this week also appeals his sentencing order and an earlier denial of his motion for a new trial.

On Dec. 16 a judge sentenced the former Gresham man to 35 to 50 years in prison. A York County jury had found Kozisek guilty of child abuse resulting in the death of Kayley Kozisek. Kayley died at an Omaha hospital on Jan. 25, 2011, a day after Kozisek called 911 and said she wasn’t breathing.

Kozisek told authorities that his 2-year-old daughter fell off a stepping stool and landed on the baby. A doctor later said such an accident couldn’t have caused Kayley’s injuries.

Ice Forces Neb. Nuclear Plant to Shut Down

fort-calhoun-dry(AP) — The Fort Calhoun nuclear power plant in eastern Nebraska has temporarily shut down due to ice buildup.

Omaha Public Power District spokesman Jeff Hanson said the plant went offline Thursday morning after subfreezing temperatures caused ice buildup on one of six gates used to control water from the Missouri River. The buildup kept the gate from fully closing.

The plant was closed because all the gates must be functional in case of flooding. The Nuclear Regulatory Commission was notified about the situation early Thursday after workers noticed the buildup hours earlier.

Hanson says workers have since cleared the ice and they are manually working on the affected gate. Once the affected gate is closed, the other gates can do the work and the plant can be back in service.
