Demo Worker Seriously Injured After Falling Down Elevator Shaft in The Old Market

the-old-marketA demolition worker has suffered serious injuries after falling down an elevator shaft in Omaha.

Authorities say the 20-year-old man was working late Thursday morning on the main floor of a building on the west side of the Old Market District. He stepped back and plunged more than a dozen feet down the shaft.

He was taken to Creighton University Medical Center.

His name hasn’t been released. The accident is being investigated.

Bellevue Couple Arrested for Repeatedly Sexually Assaulting 5-Year-Old Son

jailAuthorities say a suburban Omaha couple have been arrested, accused of repeatedly sexually assaulting their 5-year-old son.

The two are being held without bail in Sarpy County Jail on felony charges of sexual assault and incest.

The Associated Press is not using their names, to protect the privacy of the boy.

Public defender Tom Strigenz represents the mother and says she maintains her innocence. The father’s attorney has not responded to a message.

An arrest warrant affidavit says the mother told in-laws in September that she and her husband had sexually assaulted the boy. The document says she said she participated in the assaults so she could save her marriage.

A hearing is scheduled March 18 for both parents. They live in Bellevue.

Regulators in Colorado Ponder How to Tax Legal Pot

legal-potMarijuana regulators who are considering how the drug should be taxed, sold and regulated in Colorado are facing a deadline to get their ideas to state officials.

A marijuana task force plans its final meeting Thursday. The task force is giving a lengthy set of recommendations to state lawmakers and the governor’s office.

The marijuana task force has several questions still to work out. One big question is how to tax the newly legal drug. Voters wanted excise taxes to go to school construction, but pot taxes will also have to pay for safety enforcement and drug education measures. Estimates vary widely on how large the marijuana market will be.

Only Colorado and Washington have legalized pot.

4-Year-Old Left in Daycare Transport Van for Five Hours

child-caerParents of a 4-year-old girl who spent about five hours alone in a transport van after it arrived at her Omaha day care say the day care’s owners have apologized.

Monica and James Maxson are still outraged by what happened to their daughter, Haylee, on Tuesday.

They say they’ve gotten a letter from Little Lamb’s Daycare and Preschool. It says “there is no excuse for what happened. We apologize immensely for this accident.”

Sheryl and Dan Godsey own and manage the day care. Dan Godsey told Omaha television KMTV that they are heartbroken about what happened. He says three workers had checked off on paperwork indicating the van Haylee was in had been checked.

He also says the driver and the other two workers have been fired.

Lincoln Man Loses Appeal on Pot Growing Sentence

pot-growingA federal appeals court has upheld the 10-year sentence for a Nebraska man convicted of growing marijuana in Lincoln houses with his brothers.

Da Van Cao appealed after being sentenced last year to 10 years in federal prison. There is no parole in the federal prison system.

On Wednesday, the 8th U.S. Circuit Court of Appeals found that Coa’s sentence followed congressionally-mandated sentencing requirements.

Cao and two of his brothers were indicted for conspiring to grow marijuana. The Lincoln grow operation was discovered in 2010.

Authorities say Cao paid utilities on a house where investigators found more than 1,400 plants.

His brother, My Cao, was sentenced to two years in federal prison. Authorities believe the other brother, Tham Cao, returned to Vietnam.

 

Lincoln Man Gets Prison Time for Possessing Child Pornography

BRIAN-MCCARTHYA Lincoln man has been imprisoned for having nude photos of a 14-year-old Nebraska girl who police say was prostituted by her mother.

34-year-old Brian McCarthy was sentenced on Tuesday to six to 10 years. He’d pleaded guilty to four counts of possessing child pornography.

Authorities say the girl’s mother sent the photos to McCarthy after the mother and McCarthy met online last year

The mother has been convicted of prostituting her 7- and 14-year-old daughters by using online ads across south-central Nebraska. Her maximum prison sentences total 170 years.

The Associated Press is not using her name to protect her daughters’ privacy.

McCarthy already is on the Nebraska Sex Offender Registry for a 2000 conviction of sexual assault of a child.

Omaha Man Pleads Guilty to Tax Evasion

dept.-of-justiceA Nebraska man has pleaded guilty to creating an elaborate scheme to avoid paying $422,350 in taxes.

U.S. Attorney Deborah Gilg says 50-year-old Michael Haffke pleaded guilty on Wednesday as part of a deal

Prosecutors say Haffke created more than 40 different corporations as part of a scheme to hide income from the Internal Revenue Service.

Haffke also failed to file personal income tax returns from 2003 through 2008.

Haffke worked with IRS investigators to determine how much he owed. He could be sentenced to up to five years in prison and a $250,000 fine on May 31.

Fort Hood Shooter Asks for a Change of Venue

nadal-hisanThe Army psychiatrist charged in the 2009 Fort Hood shooting rampage wants his upcoming murder trial moved off the Texas Army post.

Maj. Nidal Hasan’s attorneys also are expected Thursday to discuss their request for changes in the military jury pool.

It’s unclear if the judge, Col. Tara Osborn, will rule on Hasan’s motion to plead guilty to lesser murder charges that don’t carry the death penalty. Prosecutors will proceed with the trial even if Osborn accepts those pleas, which are not part of any deal.

Hasan still faces execution if convicted of 13 counts of premeditated murder.

He wanted to plead guilty to those charges, but Army rules prohibit judges from accepting guilty pleas in death penalty cases.

Hasan also is charged with 32 counts of attempted premeditated murder.

NE Man, 20, Killed in Northern Kansas Crash

fatal-crashA Nebraska man was killed in a two-vehicle crash in Phillips County early today. The accident was reported after 8:30, 12 miles northwest of Long Island.

The Kansas Highway Patrol said a car driven by Austin Shaw, 20, of Stamford, Nebraska struck a pickup truck. Shaw’s car went in to the east ditch and rolled. Shaw died in the crash.

The pickup driver, Jessica Eshbaugh of Logan, Kansas, was flown to a Kearney, Nebraska medical center for treatment of her injuries.

12-Year-Old Omaha Girl Arrested for Filming Teacher in the Shower

omaha-psA 12-year-old girl has acknowledged that she used a cellphone camera to record a teacher taking a shower at a middle school in Omaha.

The incident happened earlier this month in the girls locker room at Nathan Hale Middle School.

An assistant principal asked to see the girl’s phone and found the video. The female physical education teacher confirmed she was the teacher in the video after viewing it.

The girl has been arrested on suspicion of intrusion of privacy and has been released to her mother.
